暴力基石上的“仙境”——杜牧《阿房宫赋》解读

阿房宫能够进入杜牧的创作视野是有其深刻的政治、现实和心理原因的,这既是对帝王宫殿的一种心理默认,又符合了文赋这种新兴文体的创作要求。杜牧在《阿房宫赋》中集中描绘了一个奇特的人间＂仙境＂,引出神秘的阿房宫主人,实际上是逐步揭露了这一梦想中的仙境其实是建筑在暴力基础上的,借古讽今,告诫封建帝王要在人间造＂仙境＂不但不能成功,反而会重蹈亡国的覆辙。     

试论网络婚姻及其法律规制

网络婚姻是以网络为媒介构成的一种婚姻关系。文章认为,网络婚姻具有虚拟性、非伦理性和非道德性、非对称性和便利性等特点,网络婚姻与传统婚姻在构成要件、存在方式、程序、本质等几方面存在较大差异,网络婚姻无论对成年人还是未成年人都有相当大的危害。因此,在网络婚姻的法律规制及管理方面,要完善现行《婚姻法》的相关规定,要完善相关离婚案件及离婚损害赔偿的法律规制,要强化对网络婚姻的社会管理和约束。     

汪曾祺叙事文学中的性爱隐喻

性爱叙事是汪曾祺成长主题的一个组成部分。汪的兴趣不在于合礼仪合规矩的性爱,而在于那些越轨破戒的性爱,性爱也是其叛逆叙事的隐喻。汪小说中的女人大胆地表达出自己的性爱需求,无视所谓清规戒律。＂红杏出墙＂故事细腻地表现了女性在不幸婚姻中的困兽之斗。汪曾祺的叛逆意识构成,是一个复杂而独特的整体。既有民间文化成分,又有西方现代性文化因子,同时也与20世纪的五四启蒙文化有着千丝万缕的联系。买卖婚姻是造成女性主体性丧失的一种典型的婚姻方式。金钱婚姻作为女性＂物化＂的表现形式,最集中地体现了女性深层意识中求安稳的依附性和劣根性。     

Predictors of Delinquent Behaviors Among Latino Youth

This study used an ecological framework to examine predictors of delinquent behaviors among 91 sixth-grade Latino youth. Both proximal and distal contextual factors were assessed to determine their impact on various forms of delinquency, such as violent behaviors, violent thoughts, substance abuse, and general delinquency (e.g., skipping school). Attitudes toward school, mobility (number of moves to new schools and neighborhoods), and exposure to community violence were distal variables, whereas attachment to parents and attachment to peers were considered more proximal variables. Environmental experiences or exposure to distressing community violence was the strongest predictor of delinquent outcomes. The results were discussed in terms of school officials' developing linkages with the community to promote safe environments for youth.

无效婚姻制度中人文主义问题的探讨

法律必须尊重人的价值,以人为本,体现人文主义精神。坚持以人为本是实现无效婚姻制度实效性的要求。我国的无效婚姻制度在内容、财产处理、子女权益以及宣告无效制度等很多方面体现了人文主义精神,但在婚姻无效的溯及力、夫妻间的权利义务关系、当事人之间的财产关系以及子女权益的保护等问题上,人文主义精神的体现程度还远远不够。文章对此进行了深入的剖析,以期使法律的人文精神得以更好地彰显。

关于探望权主体相关问题探讨

婚姻法中新增设的探望权制度,有其积极作用,但在保护子女利益方面还需完善,本文提出在坚持以保护子女利益为核心的立法宗旨的基础上,应赋予子女探望权的主体资格,子女对探望权的行使具有选择权,在一定情况下,子女有权拒绝父母的探望,而父母却不能自动抛弃其探望权。     

论网络空间中的语言暴力

网络的发展带来了舆论空间的革命性拓展,但随之也产生了语言暴力等消极言论现象。这一现象产生的原因是多方面的,突出反映在网络语言暴力主体及客体的特定性、网络发言语境的群居性、社会怨恨心理的影响等方面。     

Transformative and emancipatory literacy to empower

ABSTRACT

This paper draws on sociological and critical educational frames, particularly Bourdieu’s concept of symbolic violence, in order to contest the dominant model of literacy education that is driven by the premise of a ‘knowledge economy’. Instead it foregrounds the political, social, and economic factors that marginalise learners. Data from two projects: an ethnographic study in a Further Education (FE) College in England and a study of community-based literacy programmes in Scotland, are probed to show how literacy classes can offer spaces to challenge symbolic violence and facilitate learners to reclaim identities of success. These changes are illustrated from the learners’ views of the contrasts between their experiences of school education and literacy programmes that use transformative and emancipatory approaches. Our research demonstrates how critical education can open up spaces for a more equitable approach based on the co-production of knowledge. It is argued that making changes to policy and practice could inform and shape the literacy curriculum and its pedagogy if adult literacy can disentangle itself from instrumental approaches driven by neoliberal fusion and instead create critical space for contextualised and emancipatory learning.
