Silence in Intercultural communication

In communication,most of people’s attention focuses on verbal communication,nonverbal language as a means of exchange is often ignored.However,nonverbal language continues sending signals,and most of these signals are sent to conversational partners unconsciously.So correct understanding of these signals will help people improve effectiveness of communication.This article will focus on silence,a major part of nonverbal communication,exploring its communicative functions and cultural differences.     

Promoting student agentic engagement through curriculum: exploring the Negotiated Integrated Curriculum initiative

Building on the various works of theorists pertaining to curriculum negotiation, the Negotiated Integrated Curriculum (NIC) initiative detailed in this article attempts to redress the imbalance within curricular decision-making whereby student voice and learner agency is largely absent. The NIC initiative enquires into students’ concerns about life and constructs a curriculum to address these concerns as a mechanism that can be shaped to make learning more meaningful through agentic engagement. Based on a longitudinal study of two primary schools, this small scale, exploratory research details the influence of this process on learners and educators and the challenges that were faced during its implementation. The findings of this study examine two main issues: the first is how student voice, particularly around the decision-making of pedagogical activities, can be practically implemented to enhance the perceived relevance of a curriculum; and secondly the process of negotiation between teachers and students to achieve this. Recommendations for the promotion of learner agency and further research are discussed in the context of Irish curriculum reform.     

对“非典”时期新闻传播的科学反思——SARS肆虐三周年祭

本文通过客观描述2003年“非典”时期医学界内部对SARS病原的不同认识和争论,以及这场争论对新闻传播产生的影响,对新、旧《中华人民共和国传染病防治法》的执行作了一些重要阐释。反思是理性的表现,最终的结论是:过去认为“非典”时期的所谓“媒体集体失语”和政府控制信息、压制不报等等观点,在很大程度上是站不住脚的,因为这种观点的提出者和响应者对真实情况并不了解。     

Silence as right,choice, resistance and strategy among Chinese ‘Me Generation’ students: implications for pedagogy

The topic of silence and ‘the Chinese learner’ has been extensively studied often in relation to cross-cultural adjustment, intercultural issues, learning styles, language ability and differences of classroom expectations. These studies have often led to recommendations to understand silence and ‘the Chinese learner’ in more complex ways. However, there is a real need to go beyond just recognising the complexity and myths underlying these two notions. This article consolidates the need to recognise diversity and fluidity among this group of students and the changing time and space in which silence experiences among them are contextualised and studied. It does so by revisiting established meanings of in-class silence obtained from a qualitative case study with ‘Me Generation’ Chinese students studying in Australia, while contextualising the phenomenon in both Chinese and Australian classrooms. Pedagogical implications building upon the discussion of silence as right, choice, resistance and strategy among these students are provided.     

沉默权不应再沉默--论沉默权在我国的确立

认定沉默权是被告人的一项诉讼权利，是反对强迫自证其罪的重要内容，是现代法治国家刑事司法制度的一项重要内容，是犯罪嫌疑人、被告人能否真正享有辩护权的基础之所在。是否确认该权利厦是否建立了保障其实现的程序机制。不仅体现出一个国家在特定时期对实体真实与程序正当、控制犯罪与保障人权等相冲突的诉讼价值的选择态度，而且也反映出一国刑事程序中犯罪嫌疑人、被告人的人权状况和刑事诉讼文明进步的程度。结果表明：我国应建立符合我国国情的、适应我国刑事司法需要的“沉默权”制度。

我国《刑事诉讼法》第 12条规定未经人民法院依法判决,对任何人都不得确定有罪的原则。无罪推定原则与这一原则在有罪无罪的落脚点、沉默权、疑罪从无的规定上都存在很大的差别。“无罪推定原则”和“沉默权制度”的发展趋势,给我国刑事诉讼改革提供了重要的借鉴意义。
