当前中国教育法学研究中的若干理论问题探讨

我国20多年来开展的教育法学研究,从过于偏向对教育立法成果的研究而轻视对教育法制现实问题的探讨,到深入教育教学活动中的实际问题重视教育主体权力的研究,使教育法学研究从本体论和方法论诸方面提出了进行整体思考的价值取向问题。教育法学是“行为法学”。教育法律规范从产生到实现的全过程,实质上是教育价值法律化与教育法律价值化的转化过程。对教育法律效果进行研究和探讨,既是教育法理论研究的需要,也是教育法制实践的呼唤。当前,对教育法学研究应持的取向是:既要研究“文本中的教育法”,也要研究“行动中的教育法”,这一研究价值取向的转变,是教育法学理论研究之必需,也是中国教育法制实践的呼唤。     

吉登斯结构化理论中“行动”概念的深度审视

结构化理论是吉登斯最具原创性的理论,是立足于日常生活世界的本体论研究。该理论认为,行动具有一种能动性,这种能动性是一种"所做"而不是一种"所欲"。能动性与权力逻辑地关联在一起,权力是一种转换能力。有意图行动的意外后果表明行动者的能动性是受限制的。吉登斯正是通过澄清了行动的概念以及行动与目的、理由和动机的关系,实现了对解释社会学的第一次超越,从而建立了社会学方法的新规则。

筚路蓝缕,磨血兴学--近代湖南教育家群体简介

清末新政以后，一大批矢志教育救国的湖南知识界中坚，在教育救国思潮的激励下，磨血兴学，引领着近代湖南学校教育发展的主流方向，有力地推动了湖南传统教育近代化的进程。本文提出“近代湖南教育家群体”的概念，通过群体研究探究近代湖南学人的办学特点及其动因。     

Accelerating the introduction of the case method into Chinese business schools: an action research approach

ABSTRACT

This paper is unique in that it demonstrates how a national education department used action research to stimulate the use of the case method of teaching in business schools and other departments in universities in China. It illustrates how four different players; a teacher, her students, a government department in charge of setting education policy and selected faculty in Chinese universities were involved in the research. The research suggests that, contrary to widely held beliefs, given a well-trained and motivated Chinese instructor and careful course design Chinese students will readily accept the case method of teaching. Methods used in influencing potential adopters of the case method are discussed. Current faculty and institutional related barriers to the introduction of the case method are noted along with a proposal to institute the Scholarship of Teaching and Learning as a potential solution. The paper also illustrates how videotapes of classroom processes can be used in multiple ways within an action research project.     

行政裁决行为的可诉性探讨

我国的行政诉讼法对行政裁决行为是否可以提起诉讼没有给予明确的界定。从性质上而言，其是一种具体行政行为，理应允许对其提起诉讼；从对其进行司法审查的两种方式的效果上看，行政附带民事诉讼的方式更具有形式和实质的合理性。所以对行政裁决行为，应当改变立法上的模糊规定，以行政附带民事诉讼的方式提起对其的司法审查。     

Analyzing Suitability: Are Adult Web Resources on Physical Activity Clear and Useful?

ABSTRACT

Education is central to promoting healthy, active lifestyles, but most educational materials may be less than suitable for public dissemination. Related kinesiology studies have mainly focused on the reading grade level of print materials. Suitability encompasses more qualities than that and also concerns digital media. This study had two purposes: (a) critically appraise the suitability of free web articles focused on physical activity promotion that lay adults would locate via the Internet, and (b) determine if the suitability level of web articles was associated with their source of production. An adapted Suitability Assessment of Materials protocol was used. A sample of 139 web articles was obtained (mean publication year = 2015.97, ±2.42). The sample aggregate suitability level was satisfactory, but most were unsatisfactory on eight subdomains. Production source was associated with suitability level for two subdomains. The implications of our findings are discussed and recommendations for future research are presented.     

西方反思型实践理论综述

思想源于杜威的反思型教师教育思潮自从20世纪80年代在北美大陆兴起以后，迅速扩展到全世界，与之相关的课题成为教育家关注和研究的重点。本文对近20年来西方学者在反思型实践理论方面的研究成果进行了初步介绍，内容包括反思型实践的概念、策略以及与反思型实践密切相关的行动研究的理论。
