教育腐败的社会学解读

教育腐败指的是在教育活动中的行为主体选择搭便车消费教育这一公共物品,从而侵害教育公共性的行为,可分为教育行政腐败、学校管理腐败、学术腐败.其产生是由于部分群体成员在教育资源配置过程中,在监督和制衡薄弱的情况下,利用公权选择搭便车获得和消费教育资源.这种普遍存在的理性选择行为的后果是教育的公共性被践踏.

通过对体育公职人员风险分析模型的构建与分析,得出反腐败工作要从高薪防腐、高效勤政、严惩腐败、加强监督等多方面进行综合治理的结论,并针对性的提出反腐败对策。     

权利法哲学视野中的体育腐败及其治理原则

摘要：针对体育腐败现象,主要通过文献资料法,从权利法哲学视角对体育腐败的定义、本质及其治理原则进行法理解读,目的在于揭示体育领域腐败的深层机理并得出治理之策。体育腐败是发生在体育领域之内的腐败,是享有体育公共权力的主体滥用或怠于行使体育公共权力的行为。体育腐败可以分为两种情形,一种是利用体育职权为自己或他人谋取不正当利益;另一种情形是虽未获取不正当利益,但滥用或怠于行使体育职权致使他人利益或公共利益受损。体育腐败的本质源于在体育权利与体育权力的博弈过程中体育权利之抑制以及体育权力之嚣长,因此,体育腐败的基本治理应遵循以下两个原则：体育权利张扬原则以及体育权力制约原则。体育制度和体育道德是实现体育权利张扬和体育权力制约最有效之措施,应以体现权利张扬和权力制约的体育制度规范之“硬法”辅之以体育道德伦理的教化和治理之“软法”。     

反腐成本论

本文认为我国腐败滋生的一个主要原因就是由于腐败的制约成本、经济成本和心理成本太低造成的。通过加大监督机制的制约成本、提高破案率,加大处罚成本、从重处罚,增加经济成本和强化思想道德建设,美化养廉的“生态环境”,提高心理成本等措施来提升腐败成本,从而有效地制约腐败行为。

配偶关系的立法保护浅析--以刑事诉讼法为视角

刑事诉讼立法保护亲密的配偶关系,和追诉犯罪一样,有助于维护社会和谐。一些国家和地区注重保护实质性的配偶关系、落实保护机制、有取舍地予以保护。在我国,非法证据排除规则不能全面地保护配偶关系;配偶可能从对方犯罪的潜在证人转变为包庇、窝藏罪的被追诉人,从而难以发挥对配偶关系的刑事诉讼立法保护;此外,配偶的拒绝出庭作证特权有被架空的倾向。不妨将配偶的拒绝出庭作证特权改为配偶拒绝当面作证特权,在此基础上扩大有权拒绝当面作证的主体范围;并且赋予配偶免于强制搜查权。     

The stark reality of the ‘White Saviour’ complex and the need for critical consciousness: a document analysis of the early journals of a Freirean educator

While the anglophone academic literature has long engaged in analysis of the role of privilege in the work of educators in the Global North, this article represents an initial foray into such analysis in non-formal educational settings in the Global South. Through a cultural-textual document analysis of 12?months of personal journal entries written by the author while working as a Freirean adult educator in Mozambique, this article documents a lack of recognition of social privilege exhibited by the author in these entries, which is here referred to as the ‘White Saviour’ complex. This article also documents how the pursuit of what Freire calls ‘critical consciousness’ can effectively problematise this privileged mindset.     

Politics,religion and social connections: pillars for progression among primary teachers in Jamaica

Perceptions about teacher progression among Jamaica's primary schoolteachers should force society to stop and ask itself several questions. Are these perceptions accurate? If not, how did these perceptions emerge and what can national leaders and those in positions of authority do to ‘manage’ if not resolve these perceptions? If there is any truth to them, a different set of questions need to be asked. How did things come to be like this? How can the perception of corruption and mistrust be minimised? What will be done differently going forward? Either way, there is a more fundamental question: Do the current perceptions among teachers mirror perceptions in other areas of public service? The answers to these questions are not easy. The main aim of this small-scale qualitative exploratory study was to identify and understand the perceptions of primary schoolteachers in Jamaica as regards progression to the rank of principal. The findings point to a number of perceived barriers including religious affiliation, political affiliation, ministry- and school-level politicking, social connections and predetermined outcomes. This study concludes that promotion on any basis other than merit is problematic and does not promote trust, openness and transparency, nor does it build confidence in those who are part of the system but themselves do not have such connections and/or affiliations.
