和谐社会构建中的农民权益保护

解决好“三农”问题是全党工作的重中之重。没有农民的和谐生活,就没有全社会的生活和谐。在二元社会结构中,农民被人为地降为二等公民的不平等地位。随着社会的发展,农民的维权意识日益增强,维权行动也日趋高涨。构建社会主义和谐社会,保护农民的各项权益,对党的执政能力提出了新的要求。     

论死刑犯的权利

目前我国学者十分重视死刑犯权利问题的理论研究,但多为就事论事。本文主要从死刑犯权利的理论依据、死刑犯权利的内容、死刑犯权利的特点等进行初步分析,希望能对我国死刑犯人权保障有所裨益。     

Children's Participation in Evaluating the Role of New Information and Communication Technologies in Schools

The central thesis of the paper is that children should be accorded a greater role in the evaluation of the role of new information technologies in schools, that is, where possible they should be stakeholders who help shape the design, processes and interpretations of evaluation studies as well as informants who provide data for the study. Arguments for this position draw on children's special relationship with the new technologies as well as current movements in children's rights and the development of a new paradigm of childhood studies. The paper finishes with a discussion of some of the issues that might arise from involving children as stakeholders.     

化解我国银行不良资产:一种新途径的探索

我国银行存在着大量不良资产且不断增长,严重危害国家金融体系的稳定和国民经济的健康发展。其根源主要是产权制度缺陷和信息、交易成本问题。本文在分析现有解决方案及其不力原因的基础上,提出并说明了通过促进国有企业与非国有企业在一定程度上的相互投资合作能解决产生银行不良资产的根源问题,且这种投资合作有其内在可能性和外部可能的激励机制即有其可行性。     

2022年冬奥会赛事转播权保护问题研究

体育赛事转播侵权事件频发,随着2022年北京冬季奥运会的临近,如何更好地保护冬奥会赛事转播权成为各界关注的焦点。对冬奥会赛事转播权包含的两个层次的权利进行分析、比较,并总结了欧盟、美国、日本在体育赛事转播权方面的保护经验。由于立法倾向的不同,体育赛事转播在世界各地的保护方式亦有不同。因对体育赛事转播的独创性判定标准不同,大陆法系国家倾向于否定体育赛事节目的作品特性,而英美法系国家倾向于肯定其作品特性。结合国内司法实践,分析了通过《著作权法》以作品或录像制品的方式及《反不正当竞争法》保护均各有利弊,指出应扩大广播组织权的范围,加强对广播信号的保护,加强权利人的自我救济及市场监管部门的行政救济,为更好保护2022年冬奥会赛事转播相关权益提供借鉴。     

Evaluating the impacts of working towards the International Safeguards for Children in Sport

In this paper, the authors evaluate a global strategy to safeguard children against abuse in sport. The experiences of people within 32 of the organisations who were working towards the International Safeguards for Children in Sport were captured over a two-year study. At the organisational level, self-audits demonstrated that progress was made during the project by deliverers (who worked directly with children) from having 45% to 64% of the Safeguards fully in place. Governors (who governed other organisations which worked directly with children) improved on the same figure from 25% to 53%. Progress was also identified using the concept of Activation States through in-depth interviews at the start and end of the project. Positive changes were found at the personal level with respect to people’s feelings, knowledge and behaviours related to safeguarding as well as how safeguarding is discussed in the organisation. Group discussions also revealed changes with respect to how children, coaches, parents and the broader community were behaving with respect to safeguarding. An increase in the number of disclosures was also identified as an important impact of the project. The International Safeguards for Children in Sport are now endorsed by 125 organisations who work with a total of over 35 million children. The implications of these findings are discussed along with the future directions of work in this area.     

国际体育赛事中的人权责任与适用标准

国际体育赛事中频繁出现的人权争端对国际体育赛事的利益攸关方提出了挑战,但国际体育赛事中的人权责任不能仅仅归咎于体育组织,而应当由多方当事人组成的赛事组织共同承担。传统上解决体育争端的国际体育仲裁院并不是解决国际体育赛事中运动员人权争端以外的其他人权争端的合理机构。无论是国家法院、区域人权法院还是体育仲裁院处理人权争端,原则上都要将《联合国工商业和人权指导原则》作为衡量当事各方人权责任的标准,国际体育组织也应当在赛事的申办、筹办和主办过程中将该原则作为衡量当事各方遵守人权的标准之一。     

公民体育权利本原探析

着重论述了公民体育权利的本原、概念与体育利益内核。在有关公民体育权利的本原部分,论证了公民体育利益理论是理解公民体育权利的理论基础;在公民体育权利概念部分,论述了公民体育利益和权利的3种形态及其关系;最后,还以体育权利主体为视角阐述了体育利益是公民体育权利的实有内核。     

农民问题：中国粮食安全的根本问题?

粮食安全是国家安全的重要组成部分,是影响我国经济社会发展大局的重大战略问题。农民是实现粮食安全的经济主体,“谁来种粮”和“如何种粮”的问题的核心是农民问题,农民问题是影响粮食安全战略的根本问题,关乎国民经济全局、粮食生产稳定和农村社会和谐稳定。重视、研究和解决农民问题,是一个贯穿于我国整个改革开放和社会主义现代化进程中的时代性课题。土地问题、收入问题、权力问题、发展问题和职业培育问题是新时期正确认识农民问题的五个价值维度;以法的形式还地权于农民、千方百计增加农民收入、构建全方位的农民权利体系、全面提升农民发展能力和加快培育新型职业农民,是解决农民问题的根本举措。     

关于中超联赛产权问题的研究

本文以中超产权作为研究对象,从新制度经济学角度对中超产权进行经济学分析,运用交易费用、帕累托最优、制度变迁的经济理论,对中超产权进行经济、政策和法律的分析,进而为其未来的发展提出建议。
