基于GARCH模型的中体产业股票价格波动性实证研究

以1998年3月-2007年12月中体产业股份有限公司股票的2 535个日收盘价格指数为研究样本,运用GARCH模型对中体产业股票价格的波动性进行了实证研究,结果表明,中体产业股票价格的时间序列存在明显的非线性特征,1998年3月-2007年12月间出现两次大幅度的波动.股价收益率具有显著的波动集聚性,且表现出"尖峰、厚尾、非正态"的特征,在10%、5%、1%临界值水平下均存在显著的平稳性.GARCH(1,1)模型可较好拟合中体产业股票价格的波动变异性.股价收益率的波动具有较强的波动集聚性和持续性,且收益率当期方差冲击的79.86%在下期仍存在.从该模型的条件异方差看出中体产业股票价格的波动幅度较大,波动集聚现象较为持久.     

人权与民主关系研究

人权与民主关系密切,二者在内容上有相同之处,民主政体有利于人权保护,但二者是两个轨迹不同的运动。认为人权的实现必须以民主制度为支撑,人权运动有可能陷入如建立民主政体一样复杂的境地。无论何种社会制度,保护人权是无条件的。对于民主程度不高或非民主的政体,人权保护与民主制度可以相对分离。

从我国高校体育教学和体育消费现状入手，论证在高校建立体育股份制俱乐部的必要性和可行性，进而构建高校体育股份制俱乐部的运动模式，认为建立高校体育股份制俱乐部是促进体育教学和体育消费的有效手段。     

Ali–Frazier 1: Black Gladiators,White Promoters,and the Economics of Big-Time Boxing

Abstract

The March 1971 heavyweight championship bout between undefeated black boxers Muhammad Ali and Joe Frazier elicited numerous responses. Ali, because of his brash persona, refusal to be drafted into the Vietnam War, and outspoken criticisms of white racism, had become a potent symbol of 1960s rebellion and Black Power. Frazier, by claiming the heavyweight championship while Ali was banished, cozying up to white politicians, and refusing to criticize the US government, made himself a worthy foil for Ali’s politics. But as the rhetoric surrounding the fight intensified, regarding black masculinity, patriotism, and community pride, one key aspect of the fight opened up debates in a surprising realm: the economics of black athletes and the possibilities and limitations of black capitalism. In an era when black capitalist programmes emerged nationwide, and when African-American athletes took on more vocal roles as community activists, the battles over the bout’s financial promotion became intense. While the boxers took home an unprecedented $2.5 million each for their participation, total revenues reached nearly $30 million. Discussions of the fight’s payout shed light on a wide range of economic issues facing the black community, and some of the unresolved issues in the quest for civil rights.     

权利法哲学视野中的体育腐败及其治理原则

摘要：针对体育腐败现象,主要通过文献资料法,从权利法哲学视角对体育腐败的定义、本质及其治理原则进行法理解读,目的在于揭示体育领域腐败的深层机理并得出治理之策。体育腐败是发生在体育领域之内的腐败,是享有体育公共权力的主体滥用或怠于行使体育公共权力的行为。体育腐败可以分为两种情形,一种是利用体育职权为自己或他人谋取不正当利益;另一种情形是虽未获取不正当利益,但滥用或怠于行使体育职权致使他人利益或公共利益受损。体育腐败的本质源于在体育权利与体育权力的博弈过程中体育权利之抑制以及体育权力之嚣长,因此,体育腐败的基本治理应遵循以下两个原则：体育权利张扬原则以及体育权力制约原则。体育制度和体育道德是实现体育权利张扬和体育权力制约最有效之措施,应以体现权利张扬和权力制约的体育制度规范之“硬法”辅之以体育道德伦理的教化和治理之“软法”。     

Questioning the no-touch discourse in physical education from a children's rights perspective

In this paper we question the rationality of ‘no-touch policies’ and offer an alternative approach to the matter of physical contact between teachers and students in the context of physical education (PE) in schools. Earlier research has drawn attention to how a discourse of child protection is starting to affect how physical contact is viewed in PE practice. The avoidance of intergenerational touch is increasingly justified by referring to the children's rights agenda. Here, arguments for ‘no-touching’ are linked to children's right to be protected from harm. In the paper we explore a children's rights-based viewpoint that supports the use of and need for physical contact in PE teaching by developing theoretical and practice-based arguments. An alternative children's rights perspective, based on rights theorising, is used to formulate the theoretical argument. Interviews with 16 PE teachers about their experiences of physical contact in their pedagogical work form the practice-based arguments. The two arguments provide a way of looking at intergenerational touch in education from the vantage point of children's human right to develop to their full potential, which can support a need for physical touch in pedagogical situations.     

Reading the mass violence in Indonesia 1965–1966 as a form of primitive accumulation

Abstract

A human rights perspective is compromised in its ability to understand and respond to the mass violence that took place in Indonesia, largely against members and supporters of the Indonesian Communist Party (PKI) from 1965–1966. In “Indonesia's Original Sin: Mass Killings and Capitalist Expansion, 1965–66,” Hilmar Farid makes the point that a human rights standpoint is limited when capital or its various actors, are involved in propagating and/or perpetrating mass violence. In starting to fashion an alternative reading, Farid proposes Marx's notion of primitive accumulation. While Farid's position is suggestive, I contend that his analysis is marred by a number of theoretical weaknesses, which I attempt to sublate in this article. As such, I will offer an alternative reading of primitive accumulation perceived through a multi-dimensional local/global dialectic.

对劳动合同法中相关权利的配置进行经济分析,以权利为媒介,从劳动合同的签订(包括适用期、合同期限)、履行和解除方面,进行成本与收益的分析,探讨权利的优化配置,<劳动合同法>对劳动合同中体现的资源权属的划分和权利的配置进行了调整,有利于保障劳动者的合法权益,促进劳动关系的和谐稳定.     

环境权与人权的协调——以欧洲人权法院的实践为例

环境权与人权的概念是人的自然权利在不同时期发展变化的产物,具有历史上的相承性;二者也具有协调一致的理论基础,即可持续发展的伦理观。但在实践中,对两种权利的保护仍存在冲突。欧洲人权法院有关判例对这种冲突进行的协调提出了一条值得借鉴的环境权人权化的路径。
