面对现实生活中大量、复杂的非婚同居现象及由此而产生的诸多问题,立法必须作出回应,廓清非婚同居的内涵,使之与合法的婚姻关系和非法同居关系区别开来;对因非婚同居引起的人身关系和财产关系,应通过立法确认其处理原则及具体处理方法。     

Taking an evaluative stance to decision-making about professional development options in early childhood education and care

This article builds on our ongoing work in conceptualising an ‘evaluative stance’ framework to assist in understanding how leaders in the field of early childhood education and care (ECEC) make decisions about the selection of professional development options for themselves and their staff. It introduces the notion that evaluative mindsets can be considered in terms of attitudes towards decision-making that are based on personal epistemologies. Drawing on data from semi-structured interviews, it explores the mindsets of six experienced leaders in two long-established ECEC organisations in Australia with respect to their decision-making about professional development. The article concludes with a consideration of the potential utility of the framework and the coding template used in this exploratory study.     

面向大数据的旅游微观数据信息平台研究

传统的旅游数据获取方法已经落后于整体的旅游业发展的需求,如何获得客观准确的旅游数据,一直是一件让人头痛的事。分析大数据背景和目前旅游数据统计中的各种问题,研究出以微观数据统计为基础的旅游数据统计平台的设计方案和实现方法,利用该平台,测试性地对成都游客在2013年国庆7天消费情况进行统计分析,证明了该平台(MTIS)的实用价值。该平台基于移动互联网、LBS、数据挖掘等新技术,有很好的可行性和实用性,能够为旅游中的不同单位和个体提供优质的信息化服务。同时,该平台的应用,将带来旅游数据统计、分析、营销的重大突破。     

大数据时代的公权力监控与个人隐私保护

公权力监控与个人隐私保护是一个自从有了国家便存在的矛盾,只要国家还存在,这个矛盾就不会消失。整个人类社会就是在双方的不停博弈中不断前行。但是大数据时代的到来加剧了这一矛盾的冲突。公权力在大数据时代到来后,回去公民隐私的手段与成都都空前加强。这虽然对维护整个社会治安稳定做出了巨大的贡献,但是也严重的侵害了公民的个人隐私,引发了人们对个人权利的严重忧虑。两者间具有本质矛盾,但邮费不可调和。本文旨在探讨一种公权力监控的运用方式,时期既能满足我国维护社会长治久安的政治目的,又能使民众最大程度的保护个人隐私并接受其对个人隐私的合理利用。     

矿用钢丝绳无损检测系统的设计与实现

本文针对现有钢丝绳损伤检测采用人工检查或定期换绳存在的效率低、成本浪费严重及安全性差等问题,设计了ZSC永磁性钢丝绳在线监测系统。采用漏磁与磁通的方法,利用漏磁测量钢丝绳内外部的局部缺陷,利用磁通测量钢丝绳金属横截面积的变化。试验结果表明,该系统能够有效检测与定位钢丝绳缺陷,检测精度达95%以上。     

Effects of cold water immersion on lower extremity joint biomechanics during running

The purpose of this study was to identify the influence of cryotherapy on lower extremity running biomechanics. Twenty-six healthy male volunteers were randomised into two intervention groups: cold water (cold water at ~11°C) or tepid water (tepid water at ~26°C). They were required to run at 4.0 ± 0.2 m · s^?1 before and after they underwent water immersion for 20 min. Differences between pre- and post-intervention were used to compare the influence of water intervention during running. Peak joint angles, peak joint moments, peak ground reaction forces (GRF) and contact time (CT) were calculated using three-dimensional gait analysis. Independent t-tests were applied with a significant alpha level set at 0.05. Decreased peak propulsive and vertical GRF, decreased plantarflexion moments, increased hip flexion angle and longer CT were observed following cold water immersion. Although cold water immersion (cryotherapy) affected the running movement, none of the alterations have been related to running biomechanical patterns associated with injuries. Therefore, our results indicated that cold water immersion appears safe prior to running activities.     

永川秀芽对SD大鼠的胃损伤预防效果

对购买的永川秀芽进行SD大鼠胃损伤预防效果评价．通过建立动物模型,研究永川秀芽对胃损伤预防效果．结果表明：高浓度的永川秀芽比低浓度茶降低了血清中IL-6和TNF—α炎症细胞因子水平;永川秀芽处理组大鼠胃黏膜组织的SOD和GSH—Px活力高于对照组,接近正常组;用1000mg／kg永川秀芽灌胃后表现出最强的胃损伤抑制效果．综合分析表明,一定质量分数的永川秀芽具有较好的胃损伤预防效果．     

大学生实习期间人身伤害事故责任划分的分析--以高职院校为例

高职教育适应就业、培养实践技能的教学特色必须施以企业一线教学实习,而这期间大学生的人身伤害事故频发,因实习生的法律身份定位缺失,各方难免互相推诿。必须通过重构高职院校大学生实习期间人身伤害事故的归责原则和举证责任,重新划分各方当事人的责任,尤其是社会化过滤各方责任,从而实现对各方的保护。     

“Look for the Union Label”: Exploring the Contradictions and Complications in LGBT Terminology

This article is an exploration of the implications of the gay label applied to LGBT persons and how that label surpasses all others in its implications. The author’s particular focus is on the decades since World War II, where religious, legal, and political definitions all got mixed together into a mélange of cleavages affecting everything from the most definitive national and international proclamations to the personal behavior and beliefs of gay and straight individuals.     

比较法视角下我国高校学生伤害事故国家赔偿制度的建立

高校学生伤害事故频繁发生,我国对学生伤害事故的处理多采用民事手段,域外国家多建立国家赔偿责任。从法学理论上看,高校为公务法人、教师为公务雇员,高校与学生的关系更多地体现了行政管理关系。在此理论基础上,我国应建立高校学生伤害事故国家赔偿制度,主要包括由教师行为引起的国家赔偿责任和高校设施管理不当引起的国家赔偿。
