魏晋南北朝时期法律形式的变迁

在中国古代语境下,法律形式表述为"法"的形式是较为妥当的。所谓法的形式是指国家法的外在表现,其指向的是"法"的具体的、形式的层面。而魏晋南北朝法的形式变迁表现在法的形式的外部变化和法的形式的内部发展两个方面,主要包括科的形成、以格代科、律令分野、律学的发展、法典体例结构的变化及引礼入律等内容。魏晋南北朝法律的发展,强化了法律的儒家化进程,为封建正统法的形成奠定了基础,也体现了法的形式与内容的内在契合性。

琴筝是古筝的鼻祖,古筝是我国传统的民族乐器中的一件瑰宝,与由西域传入的唢呐、琵琶不同。相传秦筝由秦朝的蒙恬将军所造,也有人认为是汉代的京房所作。“筝,本秦声也,相传云蒙恬所造,非也。制与瑟同而弦少。”（《旧唐书·音乐志》）。秦筝的来源与秦有直接的关系,后来它也成为上及宫廷、下到百姓人人喜闻乐见的艺术形式。我们将从秦筝的来源,诗歌词赋中的“秦筝”,以及当代流传的秦筝复兴三方面进行讨论。
