欺诈行为与惩罚性赔偿——浅谈对我国《消费者权益保护法》第49条的理解

我国《消费者权益保护法》第49条规定,其目的除惩罚和制止不法行为外,还有就是鼓励消费者同欺诈行为作斗争。欺诈以是否足以误导一般消费者为成立要件,并不要求有实际损害结果,也不必考虑行为人主观上的过错问题。即使“知假买假”,经营者也构成欺诈,消费者也应受法律保护。同时,为了对欺诈行为形成有效制约,惩罚性赔偿的数额标准应有一定的灵活性。     

Evolution of an academic–public library partnership

A partnership to improve access to health information via an urban public library system was established in St. Louis, Missouri, in 2011. A multiyear project was outlined that included an information needs assessment, a training class for public library staff, information kiosks at library branches for delivering printed consumer health materials, and a series of health-related programming. The partnership evolved to include social service and community organizations to carry out project goals and establish a sustainable program that met the health and wellness interests of the community.     

Consumer engagement via interactive artificial intelligence and mixed reality

The use of immersive technologies has changed the consumption environment in which retailers provide services. We present findings from a study designed to investigate consumer responses toward a $17 million AI-embedded mixed reality (MR) exhibit in a retail/entertainment complex which combines advanced technology entertainment with retail shopping. Findings from our study demonstrate that the quality of AI (i.e., speech recognition and synthesis via machine learning) associated with an augmented object increases MR immersion associated with spatial immersion, MR enjoyment, and consumers’ perceptions of novel experiences. Collectively, these increase consumer engagement, and positively influence behavioral responses—specifically, purchase intentions and intentions to share experiences with social groups. Overall, findings from this study show that interactive AI and MR technology open new avenues to promote consumer engagement.

New Fiction,Adult Education,and the Library

Although sales of popular fiction are increasing steadily, the number of serious novelists able to support themselves by writing is decreasing. Because early library emphasis on raising popular taste has lessened and adult education efforts within libraries have diminished, libraries are often held responsible for the novelists' plight. In addition, adult education in general has moved from an emphasis on the liberal arts to a concentration on practical, "how-to" courses. The Great Book Discussion Program was the last major liberal arts adult education effort sponsored by a library. A program for discussion of subsidized quality new fiction is proposed. Novelists would be subsidized by library purchases. Such discussion groups would sometimes appear on a related public television show. The plan would provide fiction with a springboard other than publishers' promotions and literary establishment endorsements.     

Searching the History of the Health Sciences

The paper discusses major indexing tools which can be used for questions in the History of the Health Sciences. NLM's HISTLINE database is described and compared with DIALOG'S America: History and Life (File 38), Historical Abstracts (File 39), the Biography Master Index (File 88), and The Wellcome Institute's Current Work in the History of Medicine. The scope and organization of thcsc tools is explained and compared. Techniques for searching by subject and by personal name are compared. Sample searches are included to illustrate the differences and similarities.     

A Review of: “The Medical Library Association Essential Guide to Becoming an Expert Searcher: Proven Techniques,Strategies, and Tips for Finding Health Information. Jankowski,Terry Ann.”

Abstract

The Center for Families Resource Library at St. Louis Children’s Hospital was integrated into the hospital’s new Epic electronic medical records system in June 2018. The new system enables clinicians to request consults from the Center for Families Resource Library. The librarian can participate more actively and collaboratively with patient education by providing reliable health information and charting it as part of the patient’s permanent record. The article reviews improvements over the former system and reveals an enhanced role for the health services librarian.     

碳配额视角下我国省级电力核算方法研究

立足于碳配额合理分配的角度,考虑电力间接排放的归属问题,采用3种不同的计算方法,核算2008—2017年中国各省电力排放。一方面通过3种方法的对比分析研究不同原则下电力碳排放量的变化情况,另一方面为电力企业碳配额的分配提供依据参考,从而有利于提升企业减排生产的潜力和水平。     

网络环境下图书馆信息服务的新取向

计算机网络技术的发展,拓宽了人们选择利用信息资源的范围,也对传统图书馆的信息服务提出了挑战。本文在分析网络环境下图书馆用户获取信息的新要求和网络化对传统图书馆信息服务影响的基础上,对图书馆如何提高信息服务能力提出了一些想法。
