第四次修宪与刑事诉讼法再修改

在推进社会主义法制建设进程中,第四次成功修宪无疑为其他普通法律的完善做出了表率,尤其是亟待修改的与宪法密切联系的刑事诉讼法.结合宪法与刑事诉讼法两者的关系,阐述了第四次修宪为刑事诉讼法再修改所提供的宪法依据,以促进刑事诉讼法再修改的启动.     

刑事案件上诉原因文本挖掘——基于二审文书数据

[目的/意义]从刑事二审案件裁判文书中挖掘上诉理由和相关影响因素,给法院和智慧量刑系统提供相关数据。[方法/过程]以北大法宝网近一年的刑事二审案件裁判文书作为基础数据,用信息抽取、word2vec训练词向量和聚类等文本挖掘方法对文本内容进行挖掘。[结果/结论]在传统的上诉理由之外,发现了基于上诉人自身态度的上诉理由。信息抽取、word2vec训练词向量和聚类等文本挖掘方法可用于裁判文书相关内容挖掘。     

Immigrant perpetrators in the news: A terror management approach to resultant hostility,perceived vulnerability,and immigration issue judgment

This study found that mortality salience in TV news activated more hostile attitude toward the perpetrators and negative judgment on the immigration issue. Social group difference influenced news viewers’ immigration issue judgment, but did not affect their resultant hostility and perceived vulnerability. More negative attitudes emerged toward the immigration issue when immigrant perpetrators were portrayed negatively in the news. News viewers with exposure to mortality salience in TV news reported more negative toward immigrants. Exposure to mortality-related elements in TV news could lead to social conflicts that were viewed as a severe threat by U.S. government and policymakers.     

刑事和解制度的构建

在中国推行刑事和解制度有文化基础、政治基础和立法实践基础,而且有其必要性;设立该制度应在刑事和解案件的对象及范围、和解时间及限制、选任调停人、和解协议的内容与效力、试点推行等方面进行规范。     

试论短信证据的审查判断

短信作为新兴证据出现在诉讼领域,司法实务界对其审查判断存在的主要问题有:忽视短信证据能力、歧视短信证据效力、界定短信证据种类多样化。为了使短信真正被司法人员所认可,赋予短信应有的证据法律地位,必须树立正确的证据观念:理性判断短信的证据能力、正确厘清短信特性与属性的关系、明确界定短信的证据种类。并就短信的审查判断中应注意的若干问题进行了有益探讨。     

死刑双重控制论

我国在一定时期内不可能全面废除死刑,但由于我国已经签署联合国《公民权利与政治权利国际公约》,因而,应当从实体法和程序法两个方面控制死刑的适用。在实体法上,将死刑罪名控制在有限的范围内,对于性质特定的犯罪、情况特殊的罪犯,不适用死刑立即执行,而代之以其他刑罚方法;在程序法上,注意发挥审理程序在限制死刑中的作用。     

对素描基础教学现状的思考

素描基础教学应从传统的“全因素”教学法中解脱出来,应以培养学生的素描创作意识和提高学生的审美及创造能力为主。

从研究运动主体的情绪视角出发,从情绪反应的心理学成分研究入手,阐明情绪和个体判断决策的关系,进而从系统决策角度对竞技排球中运动员的个体判断与决策的重要意义。对情绪、个体判断与决策对竞技排球运动中运动员处理各类性质球的效果影响作借鉴式分析,强调情绪对新时期竞技排球运动发展的重要作用的同时,建设性提出竞技排球运动员赛前、赛中以及赛后情绪调节研究系统化策略。     

Effects of emotional exemplars in responsibility attribution-framed news reports on perception and evaluations of social issues

This study investigated the separate and combined effects of emotion-laded exemplars and responsibility frames on readers' perceptions and evaluations. Two hundred and sixty-nine students participated in an experiment involving a news story that dealt with the social issue of homelessness in South Korea. Six versions of a news story differed in emotion-laden exemplars with textual information (anger-evoking, sympathy-evoking) and responsibility news frames (attribution of responsibility to society, attribution of responsibility to individual, and no frame). This study found that, compared to the responsibility frames, emotion-laden exemplars significantly affected readers' moral evaluations toward the target individuals and their perceptions of the social issue's severity. The results also indicated that the anger-evoking exemplars influenced readers to attribute responsibility of a problem more to the target individuals than the societal system. In contrast, the sympathy-evoking exemplars prompted greater attribution to the societal system than the target individuals. The likelihood of a reader supporting related governmental aid policy was influenced by both emotional exemplars and responsibility news frames. Implications for further research are discussed.
