Analyzing Challenges to Library Materials: An Incomplete Picture

This research project used Freedom of Information requests to obtain public records from Alabama institutions about challenges to materials in public schools and public libraries. Challenges occur when a patron objects to certain content. In this analysis, we examine the records of challenges. The research questions were as follows: How many challenges occur in public schools and libraries? What is the nature of these challenges? Are there institutional or demographic factors that are correlated to the occurrence of challenges? In this exploratory study, the number of reported challenges was surprisingly low. We investigated whether reported challenges were related to certain institutional or demographic factors, but did not find any discernible relationships. The data suggest that most challenged material is retained, but that librarians may be self-censoring to reduce controversy in their collections.

文章系统梳理了美国政府信息公开制度的发展过程,着重介绍了美国《信息自由法》的出台背景、基本原则、公开的范围、豁免公开的信息类型、公开的程序、救济措施、实施过程和修订情况,分析了美国政府信息公开制度的突出特点以及对我国建立和完善政府信息公开制度的借鉴意义。     

日本信息公开制度和电子政务

信息公开制度基于其国情的发展,文章阐明了日本信息公开制度的历史背景和概貌,主要描述了日本信息公开制度的整体框架及信息公开的流程;信息公开制度是政府“e-Japan战略”的重要体现,其施行的主要手段为电子政务（e--Gov）,即日本政务信息公开窗口,将给出现行日本e--Gov的整体架构、可检索和利用的公开信息;当前,日本国家信息战略正从“e-Japan战略”（2001-2005年）向“u-Japan”（2005-2010年。ubiquitous：泛在、无所不在）转型,给出相关问题的展望;最后,对中国应如何借鉴日本的经验,给出简短的分析与讨论。     

浅谈我国票据制度的理论基础

票据制度是促进票据功能充分发挥、保证票据市场健康发展的一套规则，这套规则的设计和执行是有一定理论基础的。对于我国票据制度理论基础的争论，本文提出了自己的看法，主张应该跳出“有因无因”的争论，深化对我国票据市场发展的认识，适时推出融资性票据。     

《物权法》带来的伦理启示

《物权法》所带来的伦理启示在于：它以法律的形式确认了一种新的道德范式即“常人道德”，以这种新的道德范式作为民事立法的伦理基础，使得法律本身无悖于道德情感，法律的运行也由此具有现实性。尽管《物权法》的颁布实施引发不少的学术论争，但是，从长远来看，《物权法》无疑是我国立法史上的一个里程碑，它的颁布和实施标志着我国立法开始进入自觉追求“良法”的时代。     

Considering FERPA requirements for library patron databases within a consortial environment

This case study examines patron record privacy and the Family Educational Rights and Privacy Act (FERPA) within a consortial environment. FERPA requirements were examined, as well as college and library policy and procedure. It was determined that information in library patron records is directory information and, under most circumstances, does not need FERPA protections. However, the needs of the confidential student, who requests confidentiality of all information, including directory information, were identified as not having been addressed. Reed Library adjusted policy and procedures to meet the needs of the confidential student and fulfill FERPA requirements.

中哈霍尔果斯国际边境合作中心2008年底将正式封关运营,但对中心将来可能发生贸易争端问题尚没有设计出具体的解决方机制。借鉴全球性世界贸易组织和区域性贸易组织争端解决机制的成功经验,以中心争端解决机制的适用范围、基本原则、主体资格、组织机构、决策机制、执行程序和规则解释权限制等法律制度为基础,设计一套符合中心区域贸易安排、适应中亚经贸特色的区域解决机制。
