试论环境侵权责任

本文以一般民事侵权责任理论为基础，结合环境侵权行为的特殊性，论述了环境侵权责任的构成要件、责任的证明，并着重阐述了构成要件中的因果关系。     

Building the vocational phase of the computerized motor skills testing system for use in the Electronics and Electrical Engineering Group and Hospitality Group

Technical and vocational education emphasizes the development and training of hand motor skills. However, some problems exist in the current career and aptitude tests in that they do not truly measure the hand motor skills. This study used the Nintendo Wii Remote Controller as the testing device in developing a set of computerized testing tools to measure the hand motor skills. Through literature analyses, expert reviews, and analysis of the experimental data, it has been confirmed that these computerized testing tools are stable and effective; in addition, the test results were not influenced by gender or prior experiences with using sensor devices. Moreover, the computerized test was capable of diagnosing and measuring the hand motor skills of participants in a safe, low-cost, virtual testing environment. In focusing on the learning experiences from vocational school practice classes, this study provides a reference for decision-making regarding further education and career development.

司法认识论——基于司法认识结构的分析

司法认识是一种历史性认识,但它又与一般的历史性认识不同,在本质上有其特殊性。因此,在把握其特殊性的同时,对其内部结构即主体、客体、行为以及它们之间的相互关系,进行初步分析与研究,不仅是一种有益的探索,而且在理论和实践上都有其内在的价值。     

承认的形式以及教育意义

爱、权利的尊重和社会重视是承认的三种形式。获得承认是人性中的自然倾向,是每个人进行交往的动机。教育中的交往结构是一种相互承认的关系结构。儿童作为完整的人,其精神品格是通过教育对他的"特殊性"的承认获得发展的。教育承认包括了爱与关怀、权利的尊重、社会重视以及完整发展的内涵。在这种承认的教育关系中,不仅儿童形成了独特的、完整的、有尊严的自我,培养了主体间的道德感和共通感,而且教育本身也形成了一种友爱的共同体。     

Language teachers’ responses to educational research: addressing the ‘crisis’ of representation

ABSTRACT

While teachers are being called upon to turn to educational research and find evidence of ‘what works’, critics argue that research often suffers from a crisis of representation. They contend that research reports fail to sufficiently capture the lived experiences of research participants. In this article, I present insights gleaned from 12 in-service teachers who read and responded to a research-based article published in a peer-reviewed journal. Data were collected from the participants’ threaded discussions on a wiki discussion board and individual in-depth interviews. The analysis of data suggests that the participants viewed the research article as both a means of representation and a potential obstacle to it. Contrary to the crisis rhetoric, the majority of participants were not too concerned about the issue of representation. They interpreted the theoretical knowledge presented in the article in light of their past experiences and socio-material contexts of work. I use the concept of recognition to illustrate their interpretive readings of the research article. I conclude the article with a discussion of how a recognitive approach to representation may help us re-conceptualize the dissemination and utilization of educational research in the current climate of evidence-based practice.     

论未成年人的民事责任能力

未成年人不具有“识别能力”就不具有民事责任能力的传统观点是有缺陷的；作为自然人承担民事责任的地位或资格的民事责任能力，其有无的判断应采“出生主义”标准，因此未成年人都是具有民事责任能力的；承认未成年人具有民事责任能力有着重要的意义。

虹膜识别系统综合实验设计

为更好地传授虹膜识别的基本原理和实现方法,该文设计了虹膜识别系统的综合实验。利用Matlab语言设计图形用户界面,实现图像读取、虹膜定位、虹膜归一化、特征提取和分类识别等功能。该实验不仅可以使学生综合运用图像处理与识别知识,更好地理解虹膜识别的基本原理和方法,还能提高学生的科研素质和动手实践能力。
