公众人物隐私权案例评析

公众人物作为一个法律概念起源于美国，其对隐私权问题的探讨具有重要的理论和实践意义。美国的西迪斯诉出版公司案是一个关于公开公众人物隐私的典型案例。权利限制理论是公众人物隐私权问题的理论基础，公共利益是公众人物隐私权的行使界限，在认定时应进行个案判断，并对隐私权的限制进行严格把握。

隐私权是一项独立的具体人格权,其主旨在于保护自然人生活的自由和精神的安宁.随着人类文明的演进,人们的自我意识越来越强烈,越来越注重自己的独立人格.而随着现代生活的日趋紧张和复杂,人们的个人生活又越来越容易受到干扰和侵入,因而在现代社会,保护个人隐私就变得尤其重要.加强我国民法对隐私权的保护,建立并完善人格权法律制度,我国目前的立法应确认隐私权的概念并对之进行保护.

家庭在社会和谐中起着重要的作用,目前我国家庭中的语言交际存在着隐患,中国人口自杀率的增加,可能与此有关。本文力图通过对目前我国家庭交际中的问题进行分析,阐述并提出了家庭交际中应注意的一些原则和方法:即充分尊重对方的原则、平等原则、谐谑原则、隐私原则和诚信原则。

试论"知情权"的几个疑难问题

“知情权”是民主与法治发展的产物，其地位越来越重要，但我国的法律制度对“知情权”却存在着规范供给缺乏、理论支持乏力的重大缺陷。文章试对传统“知情权”的概念进行重组，并提出知情权和知政权两项宪法性权利。进而，从知情权和知政权与隐私权冲突的角度进一步讨论，相应的提出解决冲突的原则、办法以及有关立法建议。     

电子商务环境下网络隐私顾虑维度的评估与测量

网络隐私顾虑被认为是阻碍用户披露个人信息的重要影响因素并越来越受到学术界的重视。鉴于隐私是与情境相联系的多维、动态的概念，情境的变化会影响用户对隐私的理解，本文结合现实背景提出了电子商务环境下网络隐私顾虑的理论概念，在以往研究的基础上确定了网络隐私顾虑的构成维度，开发出初始的测量指标，然后通过3套独立的样本数据进行探索式因子分析、验证式因子分析和关联效度分析。结果表明量表具有良好的信度和效度，网络隐私顾虑由控制、收集、二次使用、错误、不当访问与补救5个维度和19个题项构成。     

Reasonable expectations of privacy

Use of the concept of `areasonable person and his or her expectations'is widely found in legal reasoning. This legalconstruct is employed in the present article toexamine privacy questions associated withcontemporary information technology, especiallythe internet. In particular, reasonableexpectations of privacy while browsing theworld-wide-web and while sending and receivinge-mail are analyzed.     

What is special about the ethical issues in online research?

In the analysis of the ethicalproblems of online research, there is much tobe learned from the work that has already beendone on research ethics in the socialsciences and the humanities. I discuss thestructure of norms in the Norwegian ethicalguidelines for research in the social scienceswith respect to their relevance for the ethicalissues of Internet research. A four-stepprocedure for the ethical evaluation ofresearch is suggested. I argue that eventhough, at one level, the problems of onlineresearch are very similar to those we find intraditional areas of social scientificresearch, there still are some issues that areunique to research online. A general model forthe analysis of privacy and data protection issuggested. This model is then used tocharacterize the special problems pertaining tothe protection of privacy in online contexts,and to argue that one cannot assume a simpledistinction between the private and the publicwhen researching in such contexts.     

Privacy. An Intercultural Perspective

This paper deals with intercultural aspects of privacy, particularly with regard to differences between Japanese and Western conceptions. It starts with a reconstruction of the genealogy of Western subjectivity and human dignity as the basic assumptions underlying Western views on privacy. An analysis of the Western concept of informational privacy is presented. The Japanese topic of ‘‘denial of self” (Musi) as well as the concepts of Seken, Shakai and Ikai (as analyzed by the authors of the companion piece on privacy in Japan) give rise to intercultural comparisons. The paper addresses the question of privacy in cyberspace and mass media. Finally the question of freedom of speech is related to the Japanese concepts of Ohyake and Watakusi.
