苏曼殊是清末民初萃集革命与创作于一身的“奇人”。综观他的六部小说,在清新飘逸、温柔凄艳的文字中,蕴含着浓厚的恋母仇父情结,而个人无意识和集体无意识恰恰是这种情结出现的根源。这种情结的作用,导致了苏曼殊在小说中呈现出过分地褒扬女性而极度地贬低男性的两极对立的情感取向。、     

The neural bases of vitality forms

Unlike emotions, which are short-lasting events accompanied by viscero-motor responses, vitality forms are continuous internal states that modulate the motor behaviors of individuals and are devoid of the autonomic modifications that characterize real emotions. Despite the importance of vitality forms in social life, only recently have neurophysiological studies been devoted to this issue. The first part of this review describes fMRI experiments, showing that the dorso-central insula is activated during the execution, the perception and the imagination of arm actions endowed with different vitality forms as well as during the hearing and the production of speech conveying vitality forms. In the second part, we address the means by which the dorso-central insula modulates the networks for controlling action execution and how the sensory and interoceptive information is conveyed to this insular sector. Finally, we present behavioral data showing the importance of vitality forms in social interactions.     

论商业广告的性质——兼论消费者对虚假广告的民事赔偿请求权

在我国采取虚假广告欺骗消费者,给消费者造成损失的事情时有发生。但要从法律上规范广告行为,赋予消费者民事赔偿请求权是一个重要的手段。根据广告的法律性质,消费者对于虚假广告的民事赔偿请求权主要有两种,一种是基于缔约过失责任的请求权,另一种是基于单方行为说引出的违约责任的民事赔偿请求权。     

媒体导向与大众情感--以民国时期的施剑翘复仇案为例

1935年11月,归隐军阀孙传芳在天津居士林被施剑翘枪杀。这场复仇奇案轰动了全国,引起媒体的广泛关注。众多媒体同情并塑造了施剑翘良好的形象,极大地引导了大众情感。在“法”与“情”的论争中,国民政府选择了民意所向的“情”的一面,施剑翘最终被特赦。“施剑翘案”是中国司法史上的大事,也是中国新闻史上的大事。该案表明近代媒体舆论力量的增强,也充分说明媒体导向容易左右大众情感。     

The majority influence on interminority attitudes: The secondary transfer effect of positive and negative contact

Among minority members, positive contact with the majority was previously found to improve not only the attitudes toward the majority but also the attitudes toward minority outgroups (the secondary transfer effect; STE). However, the roles of negative intergroup contact and minority groups’ social status in the STE have not been yet examined. Therefore, in the present study, we investigated the association between both positive and negative contact with the national majority group (Finns) and mutual attitudes among high-status Estonian (n = 171) and low-status Russian (n = 180) immigrants in Finland. Two mediators of the STE were tested: attitudes toward the majority (attitude generalization) and public collective self-esteem (diagonal hostility). While positive and negative STEs emerging via attitude generalization were expected to occur among both immigrant groups, the mediating effect of public collective self-esteem was assumed only for members of the low-status group. In both immigrant groups, the relationship between positive contact with the majority group and attitudes toward the other immigrant group was positive and indirect through more favorable attitudes toward majority group members. The same mechanism characterized negative contact, where the indirect effect was mediated by less positive attitudes toward Finns. As predicted, public collective self-esteem mediated the effects of positive and negative contact with majority group members on attitudes toward the other minority only among low-status Russian immigrants. The results call for the acknowledgement of different mechanisms explaining the STE among minority groups enjoying different social statuses in host society.     

现代化转型中法治秩序与乡村社会秩序的融合*--基于两起土地纠纷案例的农村社会治理路径探讨

城镇化的推进带来了市场行为、行政行为对中国农村的日渐渗透以及农村各类土地纠纷的日益增多与频发。案例分析表明,农村土地纠纷的处置更多受到乡村既有社会秩序的制约,农民个体的行为选择也更多取决于其所最为认同的秩序基础及其所处的社会关联。“赢官司不打”,一方面反映出行政逻辑对法治逻辑的侵蚀破坏了法治在农民眼中的权威性、公正性和严肃性,目前正式法律途径对土地财产权的保护不完全也限制了农民的行为选择;另一方面也说明在现代化转型过程中,农村社会治理不能完全寄托于法治化建设。应培育一种基于法治逻辑的新秩序,并与基于社会关联的既有乡村秩序相匹配、相融合,共同发挥作用,实现多元协同的农村社会治理格局。     

行政检查性质的界定

界定行政检查的性质应以行政法的终极价值追求为指导,并结合中国的行政执法现状。据此,应将行政检查界定为行政事实行为,同时针对事实行为不可救济的现实,设立专门机关予以救济,依此完善行政法律体系,实现行政宗旨。     

体育产业供给侧改革:投入要素、行动逻辑与实施路径——基于社会主要矛盾转化研究视角

通过文献资料调研、实地考察、专家访谈等方法,基于社会主要矛盾转化视角,对体育产业供给侧改革的投入要素、行动逻辑与实施路径进行研究。研究认为:1)中国特色社会主义步入新时代,社会主要矛盾的转化对体育产业供给侧改革提出了新要求,而体育产业供给侧改革可以有效破解体育产业中不平衡和不充分的发展问题;2)推进体育产业供给侧改革的核心工作是通过改革与创新,优化产业结构,提高劳动力、土地、资本、制度等要素的投入力度,提高全要素生产率;3)行动逻辑是构建“强政府-强市场”结合模式,不仅要用好政府“有形之手”,也要放开市场“无形之手”,发挥市场在体育资源配置中的决定性作用。具体实践中,通过深化体制机制改革、促进产业跨界融合、实施产业创新驱动、补齐产业发展短板等途径推进体育产业供给侧改革。     

从“国家意志”到“地方行动”:先秦射礼社会治理模式探析

以社会控制理论的方法探析先秦射礼的社会治理行为,认为:基于权威关系、核心利益以及情感号召基础上的强制、交换、动员等社会控制要素,在从大射仪到乡射礼的社会治理路径上存在着不同的分配与行使机制。"君与"的大射仪通过意识形态的施压、推行"知识体系"和树立"模范"标杆为强制手段,以"身份"和"资本"交换贵族的"中"与"忠",结合内在动机的激励式动员,达成了表彰"国家意志"的准集权式强制型治理形态;而"君不与"后的乡射礼则是立足政策规范,以"兴贤能"的号召、塑造"社会背景"以及引导自我操控等动员形式为举措,辅之以"禄仕"和"射义"作为民众"道德"与"君子"的回馈而实现的体现"地方行动"的分权式动员型治理风格。从"国家意志"到"地方行动",先秦射礼践行了一种准集权式的强制型与分权式的动员型治理共生共存的社会治理模式。

电子政务服务外包的成功很大程度上取决于外包模式的正确选择与潜在风险的有效掌控,研究其潜在风险对外包模式的影响对外包模式选择、风险防范具有较高的参考价值。在分析总结电子政务服务外包主要模式(BOT、BOO、BT、ASP)的关键成功因素和潜在风险因素的基础上,构建潜在风险影响外包模式选择的结构方程模型,分析"决策与合同管理风险"、"开发与运营管理风险"、"资金与成本管理风险"、"知识与战略管理风险"四类潜在风险对各外包模式的作用机制及影响程度,并依此提出外包模式选择的参考建议。
