The Southern Manifesto as Education Policy in Mississippi

ABSTRACT

In 1956, southern Congressmen signed the Southern Manifesto, rejecting the Supreme Court’s Brown v. Board of Education ruling. This moment, in the general American consciousness, marked the rise of White massive resistance to Black advancement, a racist foray doomed to be swept aside by civil rights forces and a determined federal government. The reality is more complex. In the case of education policy in Mississippi, White hardline resistance stretches from the end of the Civil War through the modern school choice debate. The advocates and opponents of school choice should know this history of racist education policy in Mississippi.

罗斯福新政在政治、经济、社会等领域的创新是对美国传统宪政体制的突破,它要求一次“宪法革命”。这些革旧布新是对政治权力和各种利益的再分配,利益和权力的重组导致了20世纪30年代的“宪法危机”。在美国法治至上和程序至上的宪政体制下,以罗斯福总统为代表的行政、国会和最高法院及有第四权之称的美国新闻界在“宪法危机”之中为各自的权力和利益博弈。为解决危机,美国政府各方在宪政体制提供的“谈判”的机制下以“斗争促团结”,相互协商和妥协,为美国社会的发展方向寻求“共识”,最后在宪政的轨道上化解了“宪法危机”,促成了“宪法革命”的实现,确立了美国现代宪政体制发展的方向,为美国找到了一条宪政体制下和谐共处的“可持续发展”之路。

法庭口译研究应该真正为中国法庭所用

论文就法庭口译如何真正为中国法庭所用做了初步探讨。法庭口译研究在中国尚处在起步阶段,很多问题已经得到初步探讨,例如：中国内地法庭口译与香港法庭口译的差距、中国与英美国家法庭口译的差距、法庭口译人才的培养、我国法庭口译面临的危机与挑战。但是少有研究针是对目前中国法庭实际情况的。很多研究对中国法庭口译的实际问题、中国法庭的独特性较少提及。因此,论文针对前人的研究做了归纳和总结,将国内目前已有的法庭口译研究进行了分类,指出了在法庭口译理论研究方面出现的具体问题,并对以后法庭口译研究的侧重点提出了建议,希望能够努力促进中国的法庭口译研究真正为中国的法庭口译实践所用。     

《基础》课模拟法庭实践教学的特性探析

通过对《思想道德修养与法律基础》课与法律专业课开展的模拟法庭教学的比较研究,分析了二者在性质、设置目的、运行设计等方面的不同,提出了现阶段依托《基础》课开展的模拟法庭属于师生自选的实践教学形式,旨在提高大学生公民的法律素质。其形式应采取表演型的礼堂式庭审,选取大学生题材的真实案例,达到更大范围的普法效果。     

Cataloging the Congressional Serial Set

ABSTRACT

Many librarians question the usefulness of the traditional cataloging of difficult historic sets in a time when more and more information moves either to the Internet or is digitized outright. One of the most challenging sets to catalog is the United States Congressional Serial Set, a 14,000+ (and growing) mega serial comprised of five monographic sub-series. The Congressional Serial Set is an anomaly since it is both monographic and serial in nature. This article examines the intricacies in cataloging government publications in an electronic atmosphere using one House document in the Serial Set as a guide and examines the two commercial digitization projects currently underway.¹     

THE SELECTION PROCESS IN LOCAL COURT REPORTING

Court reporting is a regular feature of German daily newspapers and is widely read by a third of German newspaper readers. However, only a modest number of the daily trials find their way into the press. The aim of the present study is to identify the process and criteria for selecting local court cases for press coverage. The study is based on four Dresden daily newspapers whose reporting is examined initially by means of content analysis. The results signal a focus on criminal, rather than civil, law matters as well as trials conducted in the place of publication. A second element of the research involved observation of the selection of criminal law matters at Dresden county court by reporters of the four newspapers. It was possible to identify a multi-step selection process as a result of which only a fraction of the trials were reported. Thirdly, selection factors were identified using guided interviews with court reporters and their editors. Significant factors steering selection included the seriousness of the deed, the editorial requirement for diversity of reporting, the degree to which the readers are directly affected by the event, the prominence of the participants as well as the possibility for simple presentation and illustration.
