困境与出路：我国性侵运动员犯罪行为的刑事规制探究

近年来,性侵运动员的犯罪行为频发,成为国际社会聚焦的热点。以此审视我国运动员性法益的保护,虽有强奸罪、强制猥亵罪的刑事立法,却缺乏对该犯罪行为特殊性的深入思考,既不能在惩治犯罪人方面达到理想效果,亦不能在预防犯罪方面发挥良好功能。同时,司法中的“以纪代法”、针对性缺乏、未回应被害人需求等诸多问题,亦使该犯罪行为的刑事规制效果大打折扣。所以,在该犯罪立法上应有针对性采用附属刑法进行修正,完善犯罪的特别预防与一般预防制度;司法上,积极回应被害人的诉求,努力克服刑事规制过程中的各种困境,让运动员的性法益得到全面而充分的保护。     

新时代江苏体育文化强省建设的实践与路径研究

Jiangsu province has actively responded to the call of the Party and the state of building China into a country of strong “sports power” and “cultural power”,through an all-round effort in the sectors of sports material culture,sports spiritual culture,sports system culture and sports behavior culture. Jiangsu has improved the sports organization mechanism,ensured the sports public services,inherited folk sports culture,riched sports event culture and promoted high-quality sports culture.In an effort to build a province of renowned sports culture,we have seized the opportunities,taken sports culture as a starting point,and developed a strong sports culture in Jiangsu on all fronts,the experience of which is of reference value to the development of advanced sports power in other provinces and our nation.This paper adopts the methods of document review,logical analysis and investigation,re-generalizes the connotation and standard of a province of strong sports culture on the basis of the existing research results,and discusses the construction and development practice of Jiangsu’s development of sports culture and its further construction path.

Culturalisation and devices: what is culture in cultural economy?

Theorisation of culture is often absent from research on production in the creative and cultural sector. Further, cultural production has been largely untouched by the insights of the cultural economy approach. Culturalisation is a means of addressing the question of what constitutes culture and thus a cultural (economy) approach. It is the process by which culture and cultural production combine in the ‘operationalisation of the real.’ Culturalisation underpins much scholarship in this journal by posing the (economic) real as a problem of definition in order to illustrate the operations involved in its temporary resolution. The implications of this position need further addressing. There is a feedback between culture as a problem of definition and a cultural approach. Devices can interrogate the relationship between processes of cultural definition and the conceptual parameters of a cultural economy approach. Workshopping, projects and events are put forward as cultural devices emerging from a 10-month ethnography of literary performance in Bristol, England. This illustration shows firstly, how culturalisation occurs in a designated cultural sector to contingently realise culture; and secondly, the implicit logic of cultural economy as culturalisation, typified by the device as method, so as to open a debate concerning its implications.     

Investigating Identity: Gender,Overseas Experience,and Japanese Youth

Identity is prominent in academia, despite it being difficult to define and measure due to its dynamic and multifaceted nature. In Japan, awareness of the make-up of Japanese youth is increasingly crucial as Japan becomes a more internationalized and ageing society. This paper examines, by identity mapping and discriminant analysis, the cultural identities of 94 Japanese youth. While strong Global identities separated the respondents with from without overseas experience, ties to National identities and Relationships were found respectively for males and females. This paper suggests that regarding the study of cultural identities, gender does matter – at least in Japan.     

The Impact of Receivers’ Nationality and Cultural Orientation on the Effects of Fear Appeals in Health Communication

Participants from the Netherlands (n = 52), China (n = 50), and South Africa (n = 166) either read a self-targeted or a family-targeted fear appeal message about chlamydia. Seven aspects of individual cultural orientation were measured, and six effects of the different messages. Interactions between nationality and target of threat were found on perceived severity, perceived susceptibility, and danger control. Only for perceived susceptibility, a difference in cultural orientation partly explained this interaction. The outcomes add to the doubts about claims in earlier literature about the relevance of receivers’ nationality and cultural orientation for developing a fear appeal message.

体育赛事转播权是一种新兴的复合型权利,是指电视台、视频网站、直播平台等转播机构就其制作的体育赛事节目和提供的转播信号享有的著作权或者录音录像制品权、广播组织权,同时也是指赛事组织者就体育赛事享有的"转播许可权"。对其不同层次的内容应当分别予以解读,而不宜笼统地在"体育赛事转播权"这一概念下进行讨论。对赛事组织者的权利保护,有赖于体育法对其权利予以法定化;对相应的著作权人和邻接权人的保护,需要在完善著作权法的基础上,坚持作品独创性判断标准,并提升邻接权的保护水平。     

藏羌走廊民族传统体育文化符号表征研究

采用文献资料法、逻辑推理法并结合田野考察法,以文化人类学和社会表征理论为依托,阐释藏羌走廊民族传统体育文化符号表征的意义。研究认为：藏羌走廊民族传统体育文化符号具有“三征并存”的功能结构和“三化并行”的功能价值。通过对藏羌走廊民族传统体育文化符号表征的研究,对藏羌走廊民族传统体育文化资源的传承与发展,以及人类学家和民族学家对民族传统体育文化符号的深层次研究具有导向作用。     

文化传播的异质性分化：巴西足球的表演性释读

足球是一种极易传播的游戏文化,足球在世界各地的传播大多体现出同质性,却在巴西获得了一种异质性的因素。巴西足球的特质异性来自人种的多元化,也和巴西人逍遥的文化精神相关联,又与巴西的气候及生态情况难脱干系。巴西足球给全世界民众都带来了一种超凡的技术,还展示出了热带国家特有的朝气、自由感以及灵透气质。巴西足球就此成为国家的主体精神,其品牌影响力超越了这个国家其他所有的文化类型。巴西文化只有桑巴舞和足球是世界级的,巴西文化具有单一突进的功能。巴西人没有受过战争创伤,其足球中的自由主义精神显得纯色而富有原始性。当巴西足球失去了诸多的国家威权符号的附加值后,其内在的戏剧性与游戏性就得以激活,这是巴西足球带给全世界民众的一种启示。

明清以降的镖局发展为理解地域武术文化提供了重要参考。镖局的产生是悠久地域武风的客观体现,镖师四海行镖积极促进了地域武术的交融。镖行"春点"从江湖视角揭示了地域民间结社组织的习武活动以及传统武术的大众本色,镖局中的形意拳现象与太极拳发展路径折射着地域武术拳种的时代载体信息。坚忍勇毅、诚信敬业的传统镖局精神不仅反映出地域武术与乡贤文化的有机关联,同时也是支撑中国武术持续发展的文化血脉和内在底色。
