辩护律师调查取证权的保障研究

新《律师法》对律师的调查取证权做了较大修改,进一步增强了律师的权利,但法律的立法体现并不等于法律的司法实现,律师的调查取证权利目前还存在着多重障碍,首当其冲的就是刑事实体法的立法障碍。通过对辩护律师调查取证权内容的概述,同时结合《刑法》第306条的规定,研究探讨辩护律师调查取证权存在的主要障碍,并对辩护律师调查取证权的保障问题提出建议。     

Accessions: researching,designing higher education

This brief viewpoint piece depicts educational (dis)engagements apparent in researching and (re)designing higher education in and through Accessions. Accessions, a collaborative research-design project, probed at how cultures, climates and conditions of higher education may be reproducing or reshaping social inequalities and divisions. Here, questions are asked about how these might be challenged within and potentially beyond the specific locale of one university campus. This research-design project hopes to enable a critical perspective on issues of ‘participation’, ‘impact’, ‘engagement’ and ‘internationalisation’, where regulations and measures may be resisted and disrupted.

在以视觉传媒为主的时代,奥运会开幕式因为媒体暴力和霸权作用而发生了许多质的变化,其中最让人担忧的就是其教育意义的淡化,甚至消退。而开幕式的教育意义是顾拜旦等现代奥林匹克运动先驱设置开幕式等仪式的最根本目的。比较了视觉时代前后开幕式的变化,探讨媒体导致了哪些变化以及变化的机制。在此基础得出视觉时代的开幕式正逐渐丧失了其基本的奥林匹克教育意义等结论。     

Two games in town: a comparison of dealer and auction prices in contemporary visual arts markets

The article tests a couple of hypotheses relating to markets where demand is not taken as a given, but subject to sophisticated and encompassing price-building strategies. The study uses a data set that provides quoted dealer prices for medium-sized works of 100 leading visual artists from 1970 to 2004. These data are compared with auction price results for works by the same artists. The study reports significant discrepancies with respect to the relationship between the age of artists and prices paid for their works in the two markets, and with respect to general price developments in the two markets as measured by indices.

对国家队训练场(馆)标语进行理论研究,探讨其设置理论、问题与策略。研究表明,国家队训练场(馆)标语具有时空性和专项性特点,并以可视化载体形式对运动员实施目视管理;国家队训练场(馆)标语可按内容设置、作用和形式进行分类;国家队训练场(馆)标语设置的影响因素有语言、内容、形式和传播等;国家队训练场(馆)标语可以从有效性、创新性和简洁性等方面来进行评价;目前国家队训练场(馆)标语还存在个别标语内容失当与"不良标语"、标语形式化、标语使用过度和管理机制尚未完善等问题。其改进策略是:1)从语言学视角规范国家队训练场(馆)标语用词;2)从管理学视角加强国家队训练场(馆)标语的看板与目视管理作用;3)从传播学视角拓宽国家队训练场(馆)标语的传播途径;4)从广告学视角完善或改进国家队训练场(馆)标语设计与制作形式。     

Mapping cultural assets and evaluating significance: theory,methodology and practice

Over the last decade in the UK, there has been a notable shift in the popularity and use of cultural mapping as a methodology for policy making at a regional and local level. This follows increased demand for an informed framework for planning arts and cultural facilities from local and regional government and from within the cultural sector (Evans, 2008: p. 65). The article begins with an exploration of cultural mapping within cultural policy, which explores the context for the growth in this area of activity, and why this kind of activity appeals to policy makers and organisations. It then goes on to examine four cultural mapping exercises which have been undertaken in recent years in the UK. These studies have been chosen because although they all focus the mapping of cultural assets within a specific geographic area, they differ to one degree or another in purpose, context, definition, geographic scale and methodology. They illustrate the narrow range of approaches deployed in the cultural mapping field in the UK, and as such provide a useful means of critically reviewing their limits as well as highlighting the issues and challenges faced by cultural cartography in practice. The article concludes by considering the type of mapping research that is “allowed” within the discursive confines of consultancy based cultural policy research.

消费社会大众文化的勃兴使人们开始了视觉文化转向,以此为切入点,运用文献资料法、逻辑分析法等研究方法,结合当代社会中国武术发展的实际,指出竞技武术是视觉文化转向的产物。研究认为,大众文化的视觉审美特征使竞技武术一开始就走向了表演性的审美趋向;大众文化的勃兴使武术出现了"类像"现象,消解了传统武术和竞技武术二者之间的等级次序;大众文化审美化生存中的武术发展也造成了人文思考缺失。
