论傍名牌现象法律认定标准的合理性

中华人民共和国国家工商行政管理总局部署了第二季度打击＂傍名牌＂专项执法的行动,＂傍名牌＂现象的认定标准的种类主要是＂实际混淆＂与＂可能混淆＂两种。其中关于＂可能混淆＂标准合理性的研究主要是从立法上的统一性、与国际接轨、鼓励经营者创新等角度进行论述,忽视了市场经营中最为重要的主体之一的作用,即消费者的决策方式也对认定标准提出了一定的要求。法律保护消费者不因为混淆而受到侵害,但作为判断因素之一的部分消费者经过仔细考虑选择了仿冒品的作法为傍名牌商品提供了市场,间接地促进了傍名牌现象的出现。文章尝试以行为经济学为分析工具,考虑是否存在出于针对避免消费者非理性选择产生的损害后果,及时改变法律认定标准的原因。     

“The verdict is in: A study of jury decision making factors,moment of personal decision,and jury deliberations—from the jurors' point of view”

The purpose of this study was to gain insight into jury decision waking factors, jury decision timing, and the jury decision making process by talking to actual trial jurors. Three criminal jury trials were observed, and seventeen of the jurors were interviewed after each trial's completion. The data indicate that jurors were influenced by the evidence, witnesses, lawyers, and defendant in the trials. In two trials, jurors made their decisions early; one trial produced later decisions. The jurors' reports also demonstrate that jurors considered evidence and discussed the key issues during deliberation.     

“Standing in Terri Schiavo's Shoes”: The Role of Genre in End-of-Life Decision Making

This article reports the findings from analysis of end-of-life court cases and case files from one state public guardianship administrator as well as interviews with guardians or surrogates to identify how language and principles of the courts are operationalized in end-of-life decisions for those who are unable to make decisions for themselves. We found that physicians and guardians worked well within the requirements of the genre to ensure the best interests for those whom they represent.     

Students' Perceptions of Teaching and Learning: The influence of students' approaches to learning and teachers' approaches to teaching

Nearly 500 secondary students in 24 classes were surveyed and four students in each class interviewed concerning their approaches to learning and perceptions of their classroom environment. While interviewed students with deep approaches to learning generally demonstrated a more sophisticated understanding of the learning opportunities offered to them than did students with surface approaches, teaching strategies also influenced students' perceptions. When teachers focused strongly on actively engaging students and creating a supportive environment, students with both deep and surface approaches focused on student-centred aspects of the class. In contrast, when traditional expository teaching methods were used exclusively, students with deep and surface approaches both focused on transmission and reproduction.

构建了群体在供选方案集上的α-偏比映射,并验证了该群体偏比映射满足互反性和一致性,正相关性,独立性,非强加性,非独裁性等5个偏比公理和匿名性条件.同时,还给出了一个利用α-偏比映射进行群体排序的方法.     

完善我国教育决策咨询机制的思考

健全的教育决策咨询机制是促进教育决策科学化和民主化的重要手段。目前,我国虽初步建立起了有中国特色的决策咨询体系,但还存在许多问题。因此,必须转变观念,提高决策者的咨询意识;增强咨询独立性,大力扶持民间咨询机构;明确咨询者的职责,建立责任追究制度;改进咨询方法,提高咨询服务质量;营造良好氛围,改善咨询环境条件;更新咨询者知识,优化咨询队伍的整体素质。     

基于多主体的工程项目组合决策模型研究

为了保证工程项目组合决策流程的顺利实施,将多主体系统应用于决策流程中,构建了基于多主体的工程项目组合决策流程模型。将具有自适应能力的决策主体作为模型的核心单元,设计了决策主体的逻辑结构和行为推理算法,并将工程项目组合决策流程划分为企业战略评定、单个项目评价、项目组合选择优化、项目组合执行控制以及项目组合调整5个阶段,分析了每个阶段的具体功能。最后通过模型在某建筑企业的具体应用证明了其有效性。     

基于决策主体的IT项目组合决策模型研究

提出了一种基于主体的IT项目组合决策模型(IT Portfolio Management Model based Decision Agent,ITPMM-DA),将决策主体作为IT项目组合决策过程中的核心单元,决策主体在项目目标和约束条件下,通过行为推理为IT项目组合提供有效的决策支持.详细描述了模型的7个决策步骤,并对模型的决策过程进行了设计,为实现企业IT项目收益最大化提供了有效的支持工具.     

上市公司财务困境预测模型比较研究

以因财务原因被实施特别处理的公司作为财务危机公司,有目的地选择了三类样本(房地产行业样本、不同行业的样本、房地产行业样本与不同行业样本的混合),取其发生财务困境的前两年数据,运用神经网络、决策树和支持向量机模型进行财务预警,以研究行业因素对三种模型预警准确度的影响.
