证人证言的泛书证化现象之检讨

我国三大诉讼法均将证人证言与书证规定为各自独立的证据种类，二者之间也的确存在着明显的差异，但在诉讼实践中证人证言的泛书证化现象却相当严重。本文就这一现象的形成原因、存在的弊端及所应采取的对策措施进行了探讨和分析，以期对这一问题的解决有所裨益。     

What do we learn from docutainment? Processing hybrid television documentaries

This study examined how hybrid documentary formats, which embed educational contents into narratives, are cognitively processed. Based on existing research and theories, two reception modes were identified: processing with a focus on the narrative plotline and processing with a focus on the thematic structure. In two experiments, two markers of narrative processing could be found for hybrid television documentaries: the experience of transportation and the narrative distance effect. In the first experiment, it could be shown that re-enactments and personal variables enhance the experience of transportation. The second experiment confirmed the narrative distance effect, which occurs independently of reception goals. This means that educational facts which are closely tied to the narrative plotline were learned better than distant facts, regardless of whether the recipients watched the documentary for information or entertainment purposes. The study supplements prior theories on hybrid processing and provides conditions under which narratives are appropriate for learning.

Documenting financial performativity: film aesthetics and financial crisis

Marc Bauder’s finance film, Master of the Universe (2013) won the European Documentary Film Prize in December 2014. Bauder’s film focuses on a series on interviews with a former leading investment banker, Rainer Voss, high up in one of Frankfurt’s deserted bank skyscrapers. Voss’s statements, set against the skyline of Frankfurt’s ‘Mainhattan’ financial sector, allow Bauder to constitute an aesthetic that, I argue, successfully addresses a key problem in moving image studies, namely how to find an appropriate film form to register the workings of contemporary finance. Bauder’s film offers an unusual depiction of the self-constitution and self-understanding of a banker-turned-whistleblower, focusing on Voss’s speech acts of explication and justification. Drawing on Judith Butler’s analysis of performative agency and of the separation of economics and politics through iterative perlocutionary acts, I argue that Bauder’s investigation into the performativity that establishes the autonomy of the financial sector and grants it extensive social power offers a significant aesthetic engagement with financial performativity and contributes to debates about documentary and performativity and about routes to a reconnection of economics and politics.

毛泽东在《中国社会各阶级的分析》中专门提到"焦作煤矿工人他们特别能战斗"。河南省档案馆对中福公司档案进行整理与开发并与中州古籍出版社、河南电影电视制作集团合作,开展《中福公司档案史料汇编》编纂和文献纪录片《他们特别能战斗》拍摄项目。中共河南省委办公厅、河南省档案局与上述三家参建单位共同启动了新闻发布暨研讨会,旨在让历史说话,用史实发言,协同打造文化产品,为谱写新时代中原更加出彩的绚丽篇章作出新贡献。     

A note on glass and silica in oil paintings from the 15th to the 17th century

This articles reports new discoveries relating to ground glass and silica in European easel paintings from the 15th to the 17th centuries that were created by various German, Italian and Netherlandish artists. The earliest known additions of these extenders date to the early 1430s. Glass powder of varying fineness, prepared from vessel or window cullet, is often found in red lake glazes as well as in other colours or preparatory layers of paintings. SEM/EDX analyses of the glass particles reveal a variety of chemical compositions (soda ash, wood ash, wood ash-lime, wood ash-lead, mixed alkali), which are discussed with respect to the provenance of the paintings. Historical sources on painting techniques mention glass additions most frequently to accelerate drying of oil paints, but also occasionally to facilitate grinding of pigments. Another possible function of powdered glass and silica, especially in oil-bound red lake glazes, is that of a transparent filler, as will be here discussed based on paint trials.
