从首届“南图阅读节”看现代图书馆服务精神

论文从开拓、务实、包容、协作、民本几个方面阐述了首届南图阅读节中所体现出的现代图书馆服务精神。强调在当今时代,现代图书馆人应该看到图书馆的服务对象在不断发展变化,必须及时更新服务理念,秉持现代图书馆服务精神,拓展服务范围,积极融入社会,才能更好地实现公共图书馆的社会价值。     

论周作人的散文源流观

周作人的散文理论主要集中在他的《〈中国新文学大系.散文一集〉导言》中,他的散文观念是发展的：早期主要以英国小品文为模范,后到晚明的传统中寻根,直到认为现代的理想散文应当是既有外援又有内应,他的散文逐渐从简单走向成熟。这一成熟的散文理论是在对五四启蒙精神的认同和反思的背景中形成的,他将自己对西方个性主义的向往和中国传统的士大夫的为文方式融汇起来,在散文理论及创作领域内成功示范了如何协调矛盾的甚至是异质的文化因素。     

1950年代文学政治化的形成及其实现途径

第一次文代会制定的文艺政策,对1950年代文学政治化的形成产生了决定性影响。无论是1950年代初期关于这一问题的尚存学理的讨论,还是中期＂百花时代＂的＂争鸣＂,以至后期的彻底政治化,其实质都是为文学寻找一条更好地适应政治的途径和策略。究其原因,一是民族国家的新建需要文学力量的介入,因为它对文学力量的需要远远超过它对文学性质的兴趣;二是处于民族国家新建中的个体热情高涨,在造就集体的狂欢时,不自觉中将文学政治化而无暇顾及文学的自身。     

The Swiss Willensnation at risk: teachers in the cultural gap during the First World War

As a neutral and multilingual country, Switzerland struggled with major domestic political conflicts during the First World War due to the two cultures of the French-speaking and German-speaking parts of the country. The divided cultural loyalties (‘fossé moral’, ‘Röstigraben’), consisting of Swiss-Germans supporting Germany and Swiss-French supporting France, were discussed intensively in both of the main teachers’ journals in Switzerland. Teachers felt the need to react and to promote unity from the beginning of the war. Despite the fact that the cantons are responsible for public education and, therefore, for the education of their students, teachers considered themselves called to educate their students to be national citizens rather than to be members of a language group. This threefold citizenship – communal, cantonal and national – was not scrutinised, but national unity became crucial due to the critical political circumstances. How did teachers promote and constitute citizenship for themselves and for their students in a nation united by free will during the First World War, a time of severe internal political conflicts?     

《TRIPs协议修正案》与八国回应型立法

《TRIPs协议修正案》及其所涉强制许可制度对世界上几个主要国家国内法制的影响不尽一致。世界上八个主要国家是其中的典型代表。在从合格进口成员方、合格药品、强制许可的申请内容与程序、通知义务、请求自动许可的义务、强制许可期限、专利使用费、强制许可的出口数量、反贸易转移措施和强制许可终止等几个制度方面,这八个国家在落实（（修正案》及其所涉强制许可制度的国内法制上存在着明显的差异。     

职务犯罪惩治的国际化趋势与我国的对策——以《联合国反腐败公约》对我国刑法修正案的影响为视角

《联合国反腐败公约》是一部包含刑法规范在内的兼具国际法特征的国际刑法规范,是国际刑法渊源的重要组成部分,奠定了反腐败国际合作的法律基础。这部公约在职务犯罪惩治的立法上,体现了犯罪构成要件设计严密、完整、科学、合理的特点。中国在职务犯罪惩治的国际化方面尚存在种种现实问题,尤其是在职务犯罪惩治的刑法立法方面,需要明确"严而不厉"的立法指导思想。《联合国反腐败公约》在我国生效后,全国人大常委会相继通过了三个《刑法修正案》,在相关职务犯罪的规定上根据《联合国反腐败公约》作出相应的修改和完善,适应了职务犯罪惩治国际化的趋势。     

论非物质文化遗产保护和利用的现状以及若干原则

非物质文化遗产对于人类的生存与发展具有独特的价值与意义。在我国,"非物质文化遗产"这个新概念名词已愈来愈被人们所熟悉,有关非物质文化遗产的保护和利用正成为文化界的热门话题。但是当前非物质文化遗产保护存在诸多问题,现状不容乐观。我们在非物质文化遗产保护和利用中应遵循"以人为本、活态传承、合理利用"等原则,才有利于非物质文化遗产的保护和利用。     

On Media Concentration and the Diversity Question

Abstract

Corporate mergers and the consolidation of ownership in the American communications arena have long been sources of concern. U.S. regulatory and antitrust policy traditionally attempted to secure a “diversity of voices” structurally, largely through rules regarding ownership. Although the meaning of diversity was always problematic and undertheorized, the Federal Communications Commission long set ceilings on the numbers of broadcast outlets any single person or corporation could own and enacted cross-ownership rules such as a prohibition against a corporation owning a newspaper and broadcast outlets in the same market. These rules, and the FCC's authority to make them, were upheld, occasionally even compelled, by the federal appellate courts. In the last 20 years, however, legal trends, in conjunction with political developments, have undermined the diversity rationales behind ownership rules and associated structural regulations of mass media. Paradoxically, even as media corporations are becoming larger and presumably more powerful, ownership regulations are being rescinded or struck down. This article explains this history. It concludes with a suggestion that the First Amendment metaphor of a marketplace of ideas is misplaced, and of how our thinking about media ownership and diversity might be better served by the metaphor of a mixed media system.
