清代中期以前中朝宗藩关系下的司法运作之研究

清代中前期，清朝和朝鲜宗藩关系下的司法运作之演变暗含着两层内容：其一。该司法运作政策的演变暗示着清朝在藩部属国政策上的某些变革，即对藩部实行着统一政策。而对于属国仍实行传统的宗藩政策；其二，该政策的演变同时也体现出清朝对属国的司法运作既不同于近代国际关系上两个平行主体之间的运作，也不同于近代殖民政策下属国的司法运作的特点，它是古代东亚世界里一项特殊的司法体制，既体现出宗藩体制下清方对属国的不平等性，又体现出封建时代天下观下清廷对自身司法权利认识上的缺位。本文通过对清代中前期中朝宗藩关系下司法运作演变的探讨。对这一传统的政治体制进行研究，从中揭示出这一体制所反映出的法律内涵。

The Motive of the Murder ——The Analysis of the Two Murders in Native Son

This thesis focus on the analysis of the motive of the two murders made by Bigger Thomas, a black man. The black people＇s miserable living condition is one of the reasons why the two murders happened. The white＇s bias towards the black is also responsible for them. Bigger Thomasg deformed, distorted personality is also part of the explanations for the murders.     

On the Application of the Three-Step Approach to Growth Mixture Models

This series of simulation studies evaluate, in the context of applied research settings, the impact of the parameterization of the covariance structure of the growth mixture model (GMM) on the regression coefficient and standard error estimates in the 3-step method. The results show that the 1-step approach performs better than the 3-step method across the simulation studies. However, the performance of the 3-step method depends slightly or importantly on the parameterization of the GGM from the first step, on the inclusion or not of the predictor at the first step of the analysis, on the population model, and on the type (i.e., logit vs. linear) and size of the regression coefficient estimates.     

论中国司法考试制度的完善

浅析司法实践中运用证据规则存在的法律问题

最高人民法院《证据规定》施行以后,实践中由于对该规定理解不足,出现了错误理解“谁主张、谁举证”原则,错误分配举证责任,不按照“法律真实”的证明要求判断案件,滥用司法裁量权等问题,造成处理个案中严重背离了《规定》本意,导致了不公正的结果。     

Reducing the Bias: How Perspective Taking Affects First- and Third-Person Perceptions of Media Influence

Third- and first-person perceptions (TPPs/FPPs) are considered to be biased judgments of media influence on self and others. Research suggests that perspective taking, i.e., thinking from another person’s position, decreases perceptual gaps between self and others via assimilation. In a two-factorial experiment (n = 431), we test whether this effect of perspective taking (Factor 1) holds true for the presumed influence of desirable and undesirable messages (Factor 2). Results indicate that perspective taking significantly reduces TPPs in the case of an undesirable message but not FPPs that are provoked by the desirable message. The observable effect traces back to a change in presumed message influence on the self. Presumed influence on others was independent of both factors, desirability of message influence and perspective taking. These findings are discussed in the light of cognitive and motivational explanations for FPPs/TPPs.
