社会和谐与司法公平视域下高等院校法律援助的出路与发展

与律师作为法律援助主体相比,高等院校法律援助人员在制约法官违法裁判、取得当事人信任、积极化解矛盾等方面有着更为明显的作用。加强高等院校法律援助是实现社会和谐和保障司法公平的重要举措。当前制约高等院校法律援助发展壮大的因素既有财力、物力保障不足等外部环境的制约,也有高等院校法律援助机构自身不足的主观因素。加强高等院校法律援助需要国家提供财力、物力等支持,也需要高等院校法律援助机构自身的规范建设。     

Developing Culturally Specific Tools for the Evaluation of Good Governance in Diverse National Contexts: A Case Study of the National Olympic Committee of the Islamic Republic of Iran

One of the key features of the Olympic movement is its universalistic appeal, particularly in the sense that it has sought to establish itself as a platform for universal interaction and promotion of universal values. In this paper, we consider the nature, feasibility, and implications of the IOC's promotion of its universalist position in terms of the ethical standards it promotes in relation to universal principles of good governance. A major problem in this respect is the culturally diverse set of constituencies that are incorporated within the Olympic movement, such that the imposition of ‘one size fits all’ policies may be impractical and in many instances undesirable. The authors of this paper therefore argue that although universal agreement is often impractical, general agreement may often be established. The paper therefore presents an approach to balancing centrally promoted principles of good governance with local preferences in terms of the weighting to be given to particular values within the operationalization of good governance. This approach, based on the Analytic Hierarchy Process technique, developed by Thomas Saaty and widely employed in decision-making with regard to evaluating and weighting alternatives, is introduced here in the context of the evaluation of National Sport Federations in Iran. The paper highlights ways in which this technique allows for the expression of local priorities within the general framework of good governance principles in ways which satisfied both global and local priorities. In effect, it is a practical example of what Robertson has termed glocalization. The paper concludes by applying this framework to an evaluation of the National Federation (NF) of Football in Iran as an example of how this technique will be used for the purposes of ranking NFs in terms of performance with respect to elements of good governance which will inform both self-assessment by the NF and the decision-making process for allocation of funds by government to NFs in Iran in the future.     

Globalization and the Governance of Chinese Sports: The Case of Professional Basketball

This paper aims to explore the manifestations of globalization and sport governance in China through a lens of basketball. Specific focus is centred on the extent of the universalization of the National Basketball Association's (NBA) governance model in China and the adaptation from Chinese basketball. It argues that the vertical-centralized power allocation of Chinese basketball has prevented the NBA's governance model being fully assimilated and universalized in the Chinese context. When the localization of the NBA's capitalist setting encounters the state power of China's socialist regime, Chinese political nationalism has tended to provoke a firm entrenchment to protect the government's sovereignty.     

Reality and Dilemma: The Development of China's Sports Industry since the Implementation of the Reform and Opening-Up Policy

This paper explores the history and development of China's sports industry, along with its achievements, prospects, problems, and dilemmas, beginning with the implementation of the reform and opening-up policy. The paper concludes that China's sports have been gradually transformed from a type of public welfare under the planned economy to a business under the market-oriented economy since the implementation of the reform and opening-up policy in 1978. China's sports industry has gone through three stages, i.e. the exploratory stage (1978–1992), the formative stage (1993–1996), and the development stage (1997–present), and has achieved remarkable progress since the reform and opening-up. This has made the sports industry a new and significant economic growth point in China, constituting a sunrise industry of the twenty-first century. Despite the huge potential, the further development of China's sports industry is still faced with a series of problems and dilemmas, such as its unbalanced development, the lack of independent innovation, shortcomings in the policies and regulations of the industry, and the poor management system(s).     

什么是体育社会心理学——基于20名中、外运动心理学家学术经验的考量

通过访谈20名中、外运动心理学家,采集他们基于自身专业知识、工作经历和学术思考对体育社会心理学定义、学科性质和研究内容的判断,对这些信息进行归纳分析。结果显示:1)体育社会心理学可以定义为一门研究体育情境中的人际关系、交互作用、心理过程、行为特征和体育文化心理的学科;2)体育社会心理学是社会心理学、运动心理学和体育社会学交叉形成的一个二级学科,以体育情境为基础,同时具有心理学和社会学的学科性质;3)体育社会心理学研究内容由社会心理学中与体育运动相关的内容、运动心理学中社会心理学性质的部分、体育社会学中心理和行为方面的研究、文化心理学中与体育运动相关的议题等4部分构成,主要关注8类58种研究主题。     

Club Identity/Class Identity: Negotiations of Popular Memory by Followers of the Australian Football League

A lot of the fun in contemporary sports talk relies on shared understandings about the culture of competitive sporting teams. The purpose of this paper is to explore how often humorous discourses are negotiated by sport fans as they narrate a sense of their own history and identity as followers of professional sports teams. This analysis draws on research conducted with followers of the Australian Football League (AFL), which included 21 life story interviews. As an oral historian, I was interested in how individuals negotiated popular ideas about Australian football in the ‘composition’ of their memories. This attention to the dynamic between the public and personal is described as a ‘popular memory approach’ to oral history. In this paper I explore the place of class in popular understandings about AFL club cultures. I argue that the role class plays in popular discourse around sporting club cultures is revealed more fully when we examine the ways in which individuals – in this case followers of AFL teams – make sense of it.     

消费者参与对体育品牌企业社会责任活动效果的影响机制研究

体育品牌履行企业社会责任(CSR)的压力日益增加,但实践效果并不理想,CSR活动与消费者隔离是一个重要原因。通过两个实验研究,揭示了消费者参与对体育品牌CSR活动的影响,结果发现,1)消费者参与体育品牌CSR活动会提高其品牌态度和购买意向;2)企业社会责任认同在上述过程中起到中介作用;3)这一中介作用受到消费者对CSR活动与体育品牌之间感知匹配度的调节;讨论了对体育品牌CSR战略实践的启发。

运用文献资料法、、逻辑分析、网络信息分析等研究方法对国际足联的治理体系和治理能力进行研究,认为国际足联治理体系存在先天的缺陷。     

青少年营地活动对初中生社会适应能力影响的研究

运用文献资料、实验、数理统计等方法探索青少年营地活动对青少年社会适应能力的影响与效果,得到:青少年营地活动能提高学生的个人适应,并且存在性别差异,对男生比女生有更大的正面作用。青少年营地活动能提高男生的家庭适应,而对女生家庭适应的影响不大。青少年营地活动能提高学生的学校适应,并且不存在性别差异。青少年营地活动对学生的人际适应有积极的作用,并且不存在性别差异。青少年营地活动能直接有效的提高初中学生的社会适应能力。
