试论罗尔斯《正义论》与当代政治哲学主题的转换

罗尔斯作为公平的正义理论以原初状态为正义原则选择的环境,以社会最少受惠者的生活前景为正义选择的参照点,批判了功利主义,超越了古典自由主义,突出地解决了平等问题,让自由主义的主题从自由转向平等,从而让政治哲学的主题也发生了相应的转换。     

从“择校热”看我国现阶段教育发展过程中的教育不公平现象

"择校热"现象是目前遍布全国各地,并且"愈演愈烈",而在"择校热"背后所反映出的是我国教育发展过程中"教育不公平"的问题,其核心在于"教育资源分配的不平衡"。因此本文意在从教育资源分配与"教育公平"的关系来分析"择校热"现象背后的"教育不公平"现象的本质,并提出为树立"教育公平"旗帜的一些针对性建议与政策导向。     

《政治自由主义》以后的罗尔斯

目前国内在罗尔斯的研究仍停留在地《正义论》和《政治自由主义》，而对他在《政治自由主义》出版以后的活动和思想的介绍研究仍是一个空白，据此本首先介绍了罗尔斯在这个时期的述和社会活动，然后从其新近出版的《人民法》提炼出他的弱势国家观和现实乌托邦思想的精华－－人民法原则。     

当代西方自由主义政治合法性理论探析

以罗尔斯为代表的新自由主义者与以哈耶克和诺齐克为代表的保守自由主义者,是当代自由主义为西方资本主义根本制度进行辩护的中坚力量。其中,罗尔斯的"正义"论所折射出的为平等的自由辩护所构建的合法性理论,诺齐克的"最弱意义国家"所体现的为自由权利至上辩护所构建的合法性理论,都深刻地代表和反映了当代西方社会政治、经济关系的深刻变化,同时又表现出了对传统自由主义合法性理论的深深眷恋。     

Civic Respect, Civic Education, and the Family

We formulate a distinctly 'political liberal' conception of mutual respect, which we call 'civic respect', appropriate for governing the public political relations of citizens in pluralist democratic societies. A political liberal account of education should aim at ensuring that students, as future citizens, learn to interact with other citizens on the basis of civic respect. While children should be required to attend educational institutions that will inculcate in them the skills and concepts necessary for them to be free and equal citizens, parents should be granted as much freedom as is compatible with the requirements of civic respect to raise their children in accordance with their respective 'comprehensive doctrines' (systems of beliefs and values, including religious doctrines). We consider an objection to our position drawn from the account of upbringing recently advanced by Matthew Clayton, namely, that the conception of civic respect that we advance rests on an implausible view about the limited scope of the requirements of political justice. We develop an account of the 'basic structure of society' as the appropriate subject of political justice that can overcome this objection.     

罗尔斯的正义原则对改变我国贫富差距问题的启示

罗尔斯的正义理论的形成有深刻的历史文化背景,其思想精髓在于两个正义原则的提出及系统、缜密的逻辑论证,提出了正义社会的理想模式,使社会资源和自由体系的分配更加合理.面对我国转型时期带来的严重的贫富差距现状,应汲取罗尔斯的正义原则的思想资源,科学、有效地缓解这一矛盾,切实保护弱势群体,维护社会的和谐稳定.     

罗尔斯教育公正理论情结及方法论原则批判

罗尔斯立足于自身正义论的理论脚本之上的教育公正观作为一种方法论原则,存在不可克服的理论困境。他的理论前提是建立在对人及人性纯粹的唯心主义假设和理解的基础上,是抽象的;他的理论视角是在统一尺度的规定下促进所有人的公平、平等,是片面的;他的理论归宿是以平均主义倾向追求分配上获得最大共识的真理性公正,是乌托邦的。我们应当以批判性的眼光看待罗尔斯的教育公正理论,警惕陷入罗尔斯教育公正理论情结,以防盲目地信仰其理论而做出与现实不相符的判断。     

文化多元主义语境下的普遍主义——以哈贝马斯与罗尔斯为例

上世纪六七十年代,后现代主义开始滥觞,人们提倡文化与价值的差异、多元和特殊。哈贝马斯坚持普遍主义政治的可能,其实现依赖于公共领域中的理性沟通,在立法与行政的合法程序中寻求共识。罗尔斯提出了"正当优先于善"的命题,在人们所信仰的多元化的完备性学说的基础上,公民就政治领域诸问题达成重叠共识。这种对话的普遍主义有待建构,能为我们支离破碎的世界提供一个坚实的思想基础。     

Creating In-Depth Learning Experiences by Using Rawls' “Veil of Ignorance”

Combining a variation of John Rawls' “veil of ignorance” mind experiment with role-playing and case studies allows instructors to create assignments that engage students in the full range of learning processes, encourage them to consider a wide range of viewpoints, provide them with opportunities to apply the cognitive and the affective components of learning, and make real for them world views competing for influence in the development of policies, regulations, and laws. This article presents three examples of this curriculum innovation in a graduate Human Behavior in the Social Environment sequence, followed by suggestions of its use in practice, research, and policy courses.     

制度伦理优先性的合理性及其意义——罗尔斯政治哲学方法论研究

制度伦理优先于个人德性伦理是西方道德哲学探讨的主题,古典亚里士多德主义在德性伦理的基础上对其作了论证,近代的启蒙思想家也从社会契约论的角度对其作出了证明。然而他们都只是在形而上学的视阈下替制度伦理的优先性寻找理论支持,这是罗尔斯所不能同意的。罗尔斯从道德发生论的角度为制度伦理优先性的合理性重新作了论证,从而克服了道德形而上学传统的缺陷,这对于反思与批判个人伦理原则至上论和制度建设具有非常重要的启发意义。
