论我国自白任意性规则的再构建

自白任意性规则被英美法和大陆法所共认 ,它以实体正义和程序正义为理论基础。我国刑事诉讼法中虽然也有自白任意性规则的规定 ,但是由于实体规定的粗疏和程序保障措施的缺失 ,该规定在司法实践中趋于口号化。在重新构建这一规则时 ,应该从实体构成性规则和程序保障性规则两个方面作出规定     

基于项目化管理模式的公共图书馆志愿服务探究——以天津市少年儿童图书馆志愿服务为例

公共图书馆志愿服务工作,不仅拓展了图书馆的服务层次、有效缓解人员紧缺的压力,而且也为志愿服务者提供了多维度的实践平台。本文以天津市少年儿童图书馆志愿服务为例,尝试引入项目化管理的理念,总结在实践中逐步形成的工作方法和典型例证,以期探索基层志愿行动和公益服务的长效管理模式。     

全民健身志愿服务长效化法理思考

根据《建立全民健身志愿服务长效化机制工作方案》提出的要求,从法理上分析了将全民健身志愿服务纳入法制化轨道的理论基础.建立长效化的法律保障机制应当顺应体育水平现实差距的现状,采用赛事性志愿服务与非赛事性志愿服务相结合、专业性志愿服务与非专业性志愿服务相结合以及组织性志愿服务与非组织性志愿服务相结合的模式,在法律规范的建构要以存在的问题为中心,对现有的制度进行调整和完善,实现诸法互补、保障有力的法治环境.     

义务馆员管理中的“弹性化”原则

义务馆员工作的无偿性表明义务馆员群体是道德的瑰宝。由于义务馆员具有较大的流动性,所以图书馆在义务馆员管理中既要强调规则纪律的刚性以确保管理工作的正常运行,又要强调具体情况具体处理的弹性以促进义务馆员工作的可持续发展。义务馆员管理中的弹性化原则具体体现为人员招聘、职责定位、组织管理、队伍建设等方面的灵活变化。图书馆员在日常工作中需给义务馆员以人文关怀和呵护。     

Voluntary and involuntary immigrants and adolescents’ endorsement of multiculturalism

This research examined whether the way in which migrants are defined has implications for majority group adolescents’ evaluation of maintenance of the heritage culture. Using an experimental questionnaire design, the findings demonstrate that when migrants are considered to have left their country on a voluntary basis, endorsement of cultural maintenance is lower than when migration is perceived to be involuntary. This was found to be the case when voluntary immigrants were contrasted with immigrants that have been recruited as labor migrants by the host society (Study 1, N = 843), and when voluntary immigrants were contrasted with immigrants that are forced to leave their country of origin (Study 2, N = 108). Furthermore, Study 2 found similar effects for emigrants. In both studies, national identification was negatively related to support for cultural maintenance. In addition, higher identifiers were more strongly in favor of allowing involuntary emigrants to maintain their own culture than lower identifiers. The implications of this research are discussed.

绘本作为国外小学和中学常见的课堂教材和课外读物,多年来在国内被误读为低幼读物.本文介绍了绘本的基本概念、叙事方式、阅读方式和推广途径,分析了国外绘本拥有大量作者和读者的原因,以期呼吁国内教育界能重视绘本的巨大教育价值.     

Exploring Dialectical Tensions of Leading Volunteers in Two Community Choirs

Leaders of volunteers face different challenges than leaders of paid employees due to different motivations and reward expectations. After synthesizing previous research applying dialectical theory to group members or leaders, this study examines the dialectical tensions that leaders of volunteers experienced and the communication they used to manage those tensions as reported by both the leaders and the volunteers. A constant-comparison method was used to analyze observations and interviews of members and leaders of two community choirs. The findings suggest that leaders of volunteers face eight dialectical tensions representing three broad categories: (a) task and relationship; (b) process and outcome; and (c) internal and external. Leaders negotiated these dialectical tensions through communication strategies including use of humor and appeals to artistic spirituality. These strategies represent hybridization and dualistic discourse rather than a monologic emphasis of one course of action over another.

列宁在他的《伟大的创举》一文盛赞了20世纪10年代末期发生在苏维埃俄国的"共产主义星期六义务劳动"是共产主义的实际开端。20世纪90年代初期,"中国青年志愿者"高举旗帜,进入人们的视野,很快得全社会的广泛认同,是新的历史时期的又一伟大的创举。从"共产主义星期六义务劳动"到"青年志愿者行动",近一个世纪的时空跨越,展现了人类文明和人的精神境界的不断发展、净化、升华和提高的过程,闪烁着共产主义的奕奕光辉。     

无辜者认罪的成因分析——基于美国司法实践的阐释

作为一种现实中存在的现象,虚假供述尚未引起我国司法人员的注意,而对此美固学者却进行了深入地分析。美国学者根据虚假供述成因的不同将虚假供述区分为三类：自愿性虚假供述、强迫顺从虚假供述与强迫内在化虚假供述,并对各类虚假供述的成因进行了具体的分析,美国学者对虚假供述成因的分析对我国深刻认识心理强制时代的侦查讯问具有很强的启示意义。     

基于Protege的高考志愿填报本体构建及应用研究

通过分析高考志愿填报难度大、风险大的原因,提出了通过对考生信息的采集、高考成绩标准化处理,使用Prot~g6建立高考志愿填报本体,Jena推理后可以得到匹配考生的高校、专业以及录取概率等信息,不仅缩小了考生主观选择的范围,而且提高了高校及专业志愿选择的针对性。
