Social orders and interactions among children in age-mixed classes in primary schools – new perspectives from a synthesis of ethnographic data

The article synthesises data from two ethnographic projects, which both explore interactions of children in age-mixed groups in primary schools. It illuminates critical perspectives on social orders and children's interactions in age-mixed classes by showing how pupils in age-mixed groups become involved in power relations and how the teacher's authority and institutional rules are intricately interwoven into the social orders of the peer culture. The article highlights children's complicity with the teacher and her expectations and accordingly questions the notion of an increase of children's autonomy in age-mixed groups.     

非国家工作人员不构成受贿罪共犯－兼谈新刑法废除受贿罪共犯条款的立法理由

97《刑法》对79例《刑法》及《补充规定》中有关爱贿罪的规定作了重要修改,非国家工作人员不再构成受贿罪的共犯。对贪污罪和受贿罪的共犯问题,97《刑法》采取了区别对待的刑事政策,非国家工作人员仍可构成贪污罪的共犯。立法上的这一差异,主要是基于两罪客体和非国家工作人员在犯罪中的作用的区别,以及突出对受贿犯罪惩治的针对性的指导思想。

利用先行为人的先行行为实施犯罪的行为应当如何定罪在司法实践中存在争议,无论是抢劫罪、抢夺罪还是盗窃罪都因为构成要件的部分缺失而不能简单适用。从先行为人与后行为人各自行为之间的内在关系来看,如果后行为人对于先行为人的行为抱有“利用”的故意,可以按照间接正犯来处理,否则就只能视其行为要件具体定罪了。     

Ethical Perspectives on Body Donation Following Physician-Assisted Death

The increasing availability of physician-assisted death (PAD) has opened up a novel means of making donated bodies available for anatomical dissection. This practice has come to the fore in Canada, but is unlikely to be confined to that country as legislation changes in other countries. The ethical considerations raised by this development are placed within the framework of the ethical guidelines on body donation promulgated by the International Federation of Associations of Anatomists. The discussion centers on understanding the ethical dimensions of moral complicity, and whether it is accepted or rejected. If rejected it is possible to separate ethical concerns regarding PAD from subsequent use of donated bodies, as long as there is fully informed consent and complete ethical and procedural separation of the two. Openness about the origin of bodies for dissection is essential. Students should be instructed on the nuances of moral complicity, and consideration be given to those with moral doubts about PAD. Two issues are raised in considering whether these moves represent an ethical slippery slope: the attraction represented by obtaining relatively “high quality” bodies, and the manner in which organ donation following PAD has led to challenges to the dead donor rule. Although body donation raises fewer concerns, the ethical dimensions of the two are similar. The ethical constraints outlined here have the capacity to prevent an ethical slippery slope and constitute a sound basis for addressing an innovative opportunity for anatomists.

刑法中的身份犯是指以行为人具备一定的身份作为构成要件要素的犯罪。我国刑法理论界对身份犯的研究应该说尚处于起始阶段,特别是对其在共同犯罪领域中的探讨就更显单薄。该问题的研究不仅是构建合理刑法理论体系的必要内容而且对司法实践的影响也尤为重要。

我国共犯关系脱离的刑事政策研究

共犯关系脱离应当成为共同犯罪论的一个与共犯未遂、预备、既遂和中止并列的一个范畴与问题,我国立法和理论都应当单独这一范畴。我国现行故意犯罪停止形态和共同犯罪制度规定应对共犯关系脱离问题存在漏洞。我国应在现有共犯制度基础上确立单独的共犯关系脱离制度,坚持共犯脱离一概考虑从轻、共犯脱离与共犯既遂、未遂等共存的原则。

Abstract

This article uses a critique of modernity to examine the perceived relationship between global citizenship education (GCE) and digital democracy (DD). We review critiques of citizenship education in the global imperative and of the relationship of technology to democratic engagement. An analogy expresses the problematic way that GCE and DD are both mutually compatible and complicit in ethical global justice issues. We end with a suggestion of a pedagogical framework through which educators can engage with an ethical approach to GCE and DD.     

Children's agency during transition to formal schooling

Children's transition to school is a key issue in early years of education. Research in this field points to the counterintuitive possibility that the transition to school may actually lead to a reduction rather than a facilitation of children's agency. The paper presents findings of a longitudinal comparative ethnography on children's transition from fields of early childhood education to primary school in England and Germany. Building on theoretical concepts of the sociology of childhood, the study uses the concept of children's complicity to explore how children's agency is embedded in institutional, interactional orders and how it changes during transition. The findings indicate the importance of the structure of keeping the group of children together during transition. Not only is children's participation in the new social situation in school mediated by peer cultural routines. The paper presents the argument that the complicity children develop with their teachers' expectations takes different forms when they can rely on peer cultural routines.     

共同犯罪中实行过限问题的认定

共同犯罪的实行过限是刑法共犯理论中的难点问题之一，学界从实行犯、组织犯、教唆犯、帮助犯等不同情形进行把握，明确了界定实行过限的一般标准。但在司法实践中，对转化犯、想象竟合犯、结果加重犯的实行过限问题尚有争议，笔就此以案为例做了几点思考与探析。
