由《梦珂》和《黄色糊墙纸》审视中美女权主义

《梦珂》和《黄色糊墙纸》分别是中关两国女权主义作家丁玲和夏洛特·珀金斯·吉尔曼的代表作。《梦珂》中女主人公面对男性的压迫时,只是采取“隐忍”;《黄色糊墙纸》中女主人公则联合“其他女性”采取主动行为来反抗男性世界给她的不公。两位主人公不同的反抗方式体现了中关女权主义在最初发展时期的不同特点。     

试析寻衅滋事罪的构成特征及司法认定

寻衅滋事罪从客观方面来看,与抢劫、敲诈勒索、故意伤害等罪类似,执法实践中易混淆。文章通过对该罪概念的论析和四个构成要件的阐述,探析了该罪的构成特征及司法认定,为具体工作中判断某行为是否构成该罪,以及区分罪与非罪、此罪与彼罪奠定了理论基础。     

论中国宪法监督的制度取向

宪法监督是促进宪法实施 ,实现法治的重要保障。我国的现行宪法监督制度在实践中存在的缺陷和障碍不容忽视。本文拟从当今世界上三种主要宪法监督模式及理论基础的优点和不足的分析中 ,寻找适合我国国情的成分加以移植 ,并且结合我国现行体制 ,在对当前理论观点作保留性评析中 ,提出建立我国新型宪法监督制度的初步设想。     

刑法增设虐童罪的必要性思考

近年来,我国屡屡出现严重的虐待儿童事件,严重伤害儿童的身心健康,甚至威胁到儿童的生命。然而,对于虐童的实施主体在刑法上却找不到准确的依据对其处罚。浙江温岭幼儿教师虐童事件曝光之后,司法机关以寻衅滋事罪对其采取强制措施,就暴露出立法空白导致的司法尴尬处境。因此,刑法应尽快增设虐童罪,以期预防和打击此类伤害事件的发生。     

Defiant Behavior in Two- and Three-Year-Olds: A Vygotskian Approach

Defiant behavior in two- and three-year-olds is a natural expression of a young child’s growing autonomy, and, although frustrating to adults, is a natural phase of a child’s socio-emotional growth. L.S. Vygotsky’s socio-historical theory of the development included a discussion of “crisis” periods, one of which he felt occurred at age three. The crisis that Vygotsky asserted occurred at three is characterized by a group of seven “behaviors”, all of which indicate a struggle with the child’s position in relation to family social structures. This study examined the occurrences and characteristics of defiant behavior in two-and three-year-old children during outdoor play at a child development center, and the existence and context of defiant behaviors the modern childcare setting. Patterns in defiant behaviors during play in different age groups were apparent, and suggested an instrument to facilitate the documentation and analysis of defiant behavior in modern group-care settings.

Creative Giftedness Is Not Just What Creativity Tests Test: Implications of a Triangular Theory of Creativity for Understanding Creative Giftedness

Creativity tests, at best, measure only a small sliver of the whole of creative giftedness. These tests assess aspects of creative intelligence. But creativity is at least as much a conscious decision and even an attitude toward life as it is a traditionally defined ability. This article discusses how well-intentioned gifted educators may be following the wrong path by overly relying on tests of creativity to measure creative giftedness. This article presents a triangular theory of giftedness that conceptualizes creativity largely as an attitude toward life rather than as ability based.
