公民道德五题

公民道德建设的目的在于以市场经济为基础的民主法治制度与公民之间通过良性互动而使彼此得到健康发展。而公民道德的本质、公民道德建设的重要性、公民道德与国家的关系、公民道德的制度性建设和公民不服从5个问题是其中较为重要的几个问题。

The Umbrella Movement in Hong Kong is a 79 days political protest and occupy campaigns in major areas in the city. This chronology lists the key events prior to and during the movement.     

论公务员的不服从

公务员在我国又称为行政机关工作人员 ,是指依法定的方式和法定的程序任命并行使国家行政职权的行政机关的工作人员。现代法治国家公务员与国家是一种职务上的委托关系 ,因此 ,公务员作为国家法律的执行者 ,必须服从上级命令。但是 ,如果上级命令是违法的 ,公务员是否应当服从呢 ?对此问题我国法律并未明确。本文作者认为公务员对违法命令的不服从既具有理论上的合理性又具有实践中的可行性 ,立法上应当明确。     

Ethical disobedience

The heated rhetoric surroundingdigital copyright in general, and peer-to-peerfile sharing in particular, has inspired greatconfusion about what the copyright law does anddoes not prohibit. Most of the key legalquestions are still unsettled, in part becausecopyright defendants have run out of money andgone out of business before their cases couldgo to trial. In that vacuum, some copyrightowners are claiming that their preferred rulesof conduct are well-established legalrequirements. But those claims are strategic;those rules have never been endorsed by thecourts. They are made-up rules. There's adifference between our obligation to followreal rules, and our obligation to followmade-up ones. There may be an ethicalobligation to follow real rules, even when theyseem unreasonable. But we don't have anyethical obligation to follow made-up ones. Indeed, in this context, we may have an ethicalobligation to resist them. Some copyrightowners believe the law ought to enable them tocontrol essentially all significant uses oftheir works. The law has never said that, butit gets closer and closer every day. If webehave as though the made-up rules wereactually the law, we will make that day comemuch sooner.     

浅析小品《今天的幸福》中合作原则的遵守和违背

根据格莱斯理论,日常生活中的语言交际有时候会通过间接表达来实现,并且对话当中存在规律性(胡壮麟,2006)。基于这些规律性,格莱斯提出了合作原则,以实现正常的交流。该文以小品《今天的幸福》为例,对其对合作原则的遵守和违背进行分析,旨在向读者展示小品的幽默效果是如何得以实现。     

A Comparative Study on Obedient/Disobedient Behavior in Secondary ＋ 1 Level Students

The present study was carried out to compare the obedient/disobedient behavior in secondary ＋ 1 level students. Objectives of the study were： （1） to study and compare the obedience/disobedience in secondary ＋ 1 level students on gender basis; （2） to study and compare the obedient/disobedient behavior in secondary ＋ 1 level students in relation to their stream （arts/science）; and （3） to study the interactional effect of gender and stream on the obedient/disobedient behavior in secondary ＋ 1 level school students. ODTS （obedient-disobedient tendency scale） by Mehta and Hasnain was used for the present study. The results reveal that males are disobedient in their behavior, whereas, females show the mixed behavior, i.e., both obedience and disobedience; arts students are disobedient, i.e., both boys and girls in comparison to science stream students; gender and stream have a significant interactional effect on the obedient/disobedient behavior of secondary ＋ 1 level students.

This paper considers the moralresponsibility of computer scientists withrespect to weapons development in post-911America. It does so by looking at the doctrineof jus in bello as exemplified in fourscenarios. It argues that the traditionaldoctrine should be augmented by a number ofprinciples, including the Principle of aMorally Obligatory Smart Arms Race, thePrinciple of Assistance to One's Enemies, thePrinciple of Public Debate on Weapons of MassDisruption, and the Principle of the MoralUnjustifiability of Private Wars.     

弗洛姆的"不从"说略探

在弗洛姆看来,"不从"是人类社会进步的基础和条件。不从是指对一切阻碍社会历史进步的事物的反抗。而要做到不从则需要拥有理性和自由,拥有高尚的人格结构。不难看出,弗洛姆的"不从"说有抽象、思辨和直观的局限,但其中蕴含的合理内核却具有超越时代、不断进步的价值成分。我们应批判其局限成分,吸取其精华成分,为中国的两个文明建设服务。
