民法原理不能为劳动关系的稳定诉求提供合理的法理解释,而雇员身份的特殊性可以给劳动关系的稳定诉求提供独立于民法原理的另一种法理基础。在民事身份的演化过程中,正身份和负身份的古代法含义随着契约社会的发展,转变为强势身份与弱势身份,但并非所有的负身份者都能合乎民法原理和逻辑地接受其社会化的保护政策。雇员身份与民法内在逻辑的冲突决定了民法社会化的范围无法合理地延伸至劳动关系领域。劳动关系的稳定诉求是由雇主与雇员之间的人身从属性所衍生的义务决定的。而且,人身关系先于财产关系,因而,对劳动关系而言,稳定诉求比和谐诉求更为本质。  相似文献

The goal of this study is to measure the effectiveness of a career development system implemented at a research and technology organization at satisfying the context requirements of a decree issued by the Basque Country government. Through in-depth surveying of 80 R&D professionals over the five years, the authors aimed to determine whether a career development system, when it is linked to context requirements and researchers’ contributions, could offer researchers feedback about their career aims and increase their job satisfaction. During the five years of the study, the researchers’ capacity to meet career requirements improved by 20%, and job satisfaction, although it declined at first, increased substantially in the last two years, reaching a historic high for the employee satisfaction survey.  相似文献

Financial and cultural aspects of corporate giving by UK and non-UK companies in response to the December 2004 South Asia Tsunami disaster are explored in this article. Literatures on corporate giving rationales, concepts of disaster and donor activity in disasters provide an underpinning. The article seeks to make connections between this high profile if short-lived business giving and the funding of the arts that is sought from business; and to draw tentative lessons for arts funding when seeking business support. The giving accounts in the wake of the Tsunami from a non-probability sample1 1. A probability sample is one in which each person (or company in this case) in the population has an equal chance (probability) of being selected. In a non-probability sample some people (in this case, companies) have a greater chance than others of being selected. For this study the availability of public information on the companies was the deciding factor on being selected. View all notes of 56 UK companies and 16 non-UK companies were examined. Reported online to the UK charity Business in the Community, these accounts were accessed in February 2005 and scrutinized thematically. Concurrently, company financial profiles to accompany giving figures were constructed. Although linkages between donation levels and financial performance were lacking, emerging themes included the role of employees, influencing company giving and creating a climate of expectation of firms' contributions. These developments may have important implications for business funding for the arts, where leading philanthropists are prominent as individuals in the giving landscapes; but employees' collective involvement is not marked. Alternatively, cultivation of employees as would-be donors, indirectly via their firms, may be a more secure, if lower level route to funding for some arts organizations than dependence on high profile business leaders. The article considers alternative scenarios for company giving in disaster contexts, including as a sustained and lasting giving theme or as company support as a ‘one-off’ event, rock-star style. The likely development of employee power as a key element in company giving is explored; and its wider meanings for funding in arts settings, (where the giver as rock star heroine/hero is also prominent) are considered.  相似文献

This case study explores how the National Basketball Association (NBA) can rebuild its reputation in response to recurrent player scandals. The case centers on a reputation management firm that has been contracted by the league. The firm has been asked to develop programs that will permit players to make better decisions in their personal lives. NBA commissioner Adam Silver believes such programs will curb the likelihood of future player scandals, thereby enhancing the players’ lives and limiting their ability to damage the league's reputation. To commence the process, the firm has been invited to sit-in on a meeting with Commissioner Silver and a group of NBA staff members who have past work experiences assisting players with their transition to the NBA.This reputation management case study is positioned in two key areas: impression management and employee assistance programs (EAPs). Upon reading the case, answering the provided questions, and completing the activities, students should come to a better understanding as to how to proactively manage corporate reputation. While fictitious names are given, the case study is based on actual interviews with current NBA staff members. The case is ideal for courses pertaining to strategy, policy, organizational behavior, and human resource management. The case could also be useful for sport marketing and sport finance courses if adapted to investigate how the created programs are important for branding and value.  相似文献

The literatures on ‘varieties of capitalism’ (VoC) and ‘national innovation systems’ (NIS) propose very similar arguments about how firms require different types of labour qualifications to pursue strategies of radical product innovation (RPI), incremental product innovation (IPI), and product imitation (PI) respectively. Despite their similar lines of reasoning, however, the VoC scholars are concerned with the skill profiles of a firm's entire workforce, whereas the NIS proponents focus on the knowledge base of scientists. Given that both literatures have developed without explicitly taking the arguments of the neighbouring discipline into account, it is thus unclear whether they explain the same, or different, phenomena. Furthermore, both literatures propose firm level arguments but test them on the basis of macro- rather than micro-level indicators. This paper therefore asks: first, does micro-level evidence support the VoC and NIS arguments that particular types of employee skills and knowledge backgrounds of scientists are needed for different competitive strategies? And, if so, do RPI, IPI, and PI firms need to employ scientists in combination with a workforce having the respective qualifications, or is it sufficient if scientists or employees alone are adequately qualified. Quantitative analyses indicate that a particular mix of scientific knowledge combined with employee skills facilitate RPI, IPI, and PI strategies. The article thus concludes that - despite their similar reasoning - the VoC and the NIS literatures indeed describe different phenomena, without being aware of the synergies created whenever adequate employee and scientific qualifications are hired together.  相似文献

馆员沉默是指馆员对图书馆存在的问题选择沉默并保留观点,或者提炼和过滤自己的观点的一种行为。这种现象的存在是由社会文化、图书馆、馆长和部门主任、同事以及馆员自身的原因造成的,并对图书馆和馆员产生消极的影响。根据其形成机制,可以采取发挥图书馆组织文化的导向功能、建设学习型图书馆、革新图书馆管理模式、建立有效的沟通体系、创建馆员激励机制等应对措施,扭转"馆员沉默"现象。  相似文献
