国际专利申请中保密审查制度的实践检视——基于科技创新和技术引进视角下的探讨

专利法第三次修改对保密审查的规定做出调整,以促进多元主体下重大专利的保密,但实施过程中出现的审查效率低、缺乏补偿措施及制约科研发展等问题使向外申请保密审查制度在某种程度上偏离原先设定的功能,影响了专利申请人的合理利益和国内外先进技术的合作研发。为实现国家安全、专利权人合理利益及技术引进间的平衡,我国应借鉴国外的先进经验,简化审查程序,建立快速通道,提供救济途径,充分发挥保密审查在科技创新中的积极作用。     

College/University Counseling Centers Supporting Study Away: Challenges and Opportunities

Research points to significant numbers of students on college campuses experiencing mental health distress and an ever increasing number of college students who are choosing to make an off-campus educational experience a part of their college careers. When we consider both of these trends together, it is quite apparent that a significant number of students with mental health concerns will spend periods of time studying away from campus, with converging concerns among college mental health and study away professionals about how to best support these students. This article seeks to outline both challenges and opportunities inherent in the collaboration between campus professionals in supporting students with mental health issues before and during their study away experiences.     

Ethical issues of online communication research

The paper addresses severalethical issues in online communication researchin light of digital ontology as well as theepistemological questions raised by theblurring boundary between fact and theory inthis field. The concept of ontology is used ina Heideggerian sense as related to the humancapacity of world construction on the basis ofthe givenness of our being-in-the-world.Ethical dilemmas of Internet research thusarise from the tension between bodily existenceand the proper object of research, i.e., onlineexistence. The following issues are beingconsidered: online identity, online language,online consent and confidentiality. We alsoargue that research ethics in the US followsthe utilitarian tradition, while Europeanresearchers are deontologically oriented. Aguideline of best practice in online researchethics is proposed.

This article addresses what reference librarians should do when patrons ask for information about explosives or dangerous drugs, and explores how reference librarians can possibly deter people from dangerous, unmediated searches by proactively providing information and actual examples on the dangers and risks of making and using these materials.

"高自杀风险"大学生不认同保密例外是高校心理咨询实践中的难题,严重伤害咨访关系,不利于日后开展心理援助。"高自杀风险"大学生不认同保密例外与危机状态下的心力委顿、污名化与病耻感、对学校和家长的不信任这三个方面有密切关系。心理咨询师在实施保密例外之前要按照知情同意的原则,选择合适时机,从抑郁发作的危险性、社会支持的重要性、心理危机干预管理制度、保密例外的范围和内容这几个方面来说服"高自杀风险"大学生接受并认同保密例外。     

新律师法视野下辩护律师保密制度的完善

辩护律师的保密制度是现代刑事对抗式诉讼制度的关键要素之一,其包括保密义务和职业特权两大方面。该制度的缺失可能让辩护制度流于形式,刑事辩护目的形同虚设,甚至使律师背离其辩护职能,而成为国家追诉被告人的工具。从新律师法修改的内容出发,以国际视野看待我国辩护律师的保密制度,阐述新律师法对辩护律师职业特权的扩张及差距,进而结合我国实际进行法律梳理和理性分析,对辩护律师的保密制度在我国的完善提出设想。     

Confidentiality With Minors: The Need for Policy to Promote and Protect

Abstract

This article presents research about school counselors' attitudes toward breaching confidentiality that the authors conducted immediately before and after the tragic shootings at Columbine High School in April 1999. Two groups of school counselors were demographically similar but differed significantly in their predictions as to whether they would breach confidentiality and in their attitudes toward certain aspects of school counselor practice such as informed consent. School counselors at all levels of employment reported that they were less likely to breach confidentiality after the highly publicized high school shootings and that they were more responsible to their minor clients than to the parents of those clients. Implications for policy makers are discussed.
