在对美国的四大球职业联盟纪律处罚机制分析的基础上，着重对处罚中的程序公正性展开剖析，对处罚中程序不公正时的救济方式进行研究。结合国外案例和我国职业体育纪律处罚中的假球现象进行分析和比较，明确了程序公正性在纪律处罚机制中的核心地位，突出完善我国职业体育纪律处罚机制和健全我国多元体育纠纷救济机制的必要性。     

论审判委员会制度的改革

审判委员会是人民法院内部对审判工作实行领导的组织形式。审判委员会的职能是讨论重大、疑难、复杂案件的法律适用问题，总结审判经验，对审判工作带有根本性问题、全局性问题进行研究和作出权威性指导，现行的审判委员会制度存在着严重的弊端，亟待改革。

我国的宪政体系设计是在人民代表大会制度下的行政权与司法权的相对分立,人民法院依法独立行使审判权这是我国宪法确定的一项基本司法原则。作为审判权的行使机关人民法院与行政机关就审判权的行使联合下发文件的做法违背了我国宪政制度的设计,不利于依法治国方略的贯彻实施,最终将损害司法权威和司法公信力。

文化语境的意蕴下,公正司法是在一定历史阶段的社会生活中,在交流沟通的过程中,受各种主客观因素的影响,参与司法的主体通过司法实践而形成的对司法程序和实体的整体价值判断。刑事司法的制度创新,需要在刑事案件侦查、起诉和审判制度中体现刑事被害人参与和评价作用,以实现公正司法。     

Distributors and film critics: does it take two to Tango?

Previous literature has documented the impact of critics on audience choices of movies. We investigate three issues regarding professional critics in the motion picture industry. First we document whether and to what extent critics and their recommendations exhibit a statistical bias toward specific studios. We show that reviews by a number of critics are significantly affected by the film distributor’s identity. A second question is whether audiences are able to distinguish between biased and unbiased critics. We cannot support the view that audiences put less weight on the views of biased critics; in fact, they may listen to them more. Third, we try to characterize critics who are more prone to bias. Surprisingly, but in accord with reputation models, we find that more reputable critics may be more biased; in particular, critics based in L.A. tend to significantly prefer specific studios.

Provider fairness across continents in collaborative recommender systems

When a recommender system suggests items to the end-users, it gives a certain exposure to the providers behind the recommended items. Indeed, the system offers a possibility to the items of those providers of being reached and consumed by the end-users. Hence, according to how recommendation lists are shaped, the experience of under-recommended providers in online platforms can be affected. To study this phenomenon, we focus on movie and book recommendation and enrich two datasets with the continent of production of an item. We use this data to characterize imbalances in the distribution of the user–item observations and regarding where items are produced (geographic imbalance). To assess if recommender systems generate a disparate impact and (dis)advantage a group, we divide items into groups, based on their continent of production, and characterize how represented is each group in the data. Then, we run state-of-the-art recommender systems and measure the visibility and exposure given to each group. We observe disparities that favor the most represented groups. We overcome these phenomena by introducing equity with a re-ranking approach that regulates the share of recommendations given to the items produced in a continent (visibility) and the positions in which items are ranked in the recommendation list (exposure), with a negligible loss in effectiveness, thus controlling fairness of providers coming from different continents. A comparison with the state of the art shows that our approach can provide more equity for providers, both in terms of visibility and of exposure.

法官惩戒制度在保障法官身份，制约监督法官行为方面有着重要意义，我国法官法规定了法官惩戒制度很多方面都存在缺陷，我国存在的另一种惩戒法官的制度－错案追究制，因其本身的不合理性应予摈弃，对法官的惩戒应立足于对行为的控制，应立足本国国情，借鉴国外经验，并制度化，法律化。

Application of Sigma Metrics for the Assessment of Quality Assurance in Clinical Biochemistry Laboratory in India: A Pilot Study

Ensuring quality of laboratory services is the need of the hour in the field of health care. Keeping in mind the revolution ushered by six sigma concept in corporate world, health care sector may reap the benefits of the same. Six sigma provides a general methodology to describe performance on sigma scale. We aimed to gauge our laboratory performance by sigma metrics. Internal quality control (QC) data was analyzed retrospectively over a period of 6 months from July 2009 to December 2009. Laboratory mean, standard deviation and coefficient of variation were calculated for all the parameters. Sigma was calculated for both the levels of internal QC. Satisfactory sigma values (>6) were elicited for creatinine, triglycerides, SGOT, CPK-Total and Amylase. Blood urea performed poorly on the sigma scale with sigma <3. The findings of our exercise emphasize the need for detailed evaluation and adoption of ameliorative measures in order to effectuate six sigma standards for all the analytical processes.
