金融衍生品交易信息披露法律制度探析

金融衍生品具有规避风险和套期保值的功能，同时也不可避免地带有放大和扩散风险的缺陷。我国的金融衍生交易信息披露制度建设在立法、执法、司法等诸多方面存在不足，加强和完善我国金融衍生交易信息披露法律制度建设，一方面需要借鉴发达国家和地区的有益经验，另一方面则需要立足于我国的实际情况，明确信息披露制度建设的基本原则，落实信息披露制度建设的具体措施，从多个方面来完善我国的相关制度建设。

Analysis on the Legal System of Information Disclosure on Transaction of Financial Derivatives

Financial derivatives have functions of hedging and avoiding risks,meanwhile,they also inevitably have defects of magnifying and spreading risks.There are some faults in legislation,law enforcement and jurisdiction on the information disclosure for the financial derivative transaction.Therefore,We should try our best to improve this system from the following two aspects.On one hand,we ought to learn from developed countries and regions;on the other hand,we should clarify the basic principles of the information disclosure system and take some measures to guarantee transaction safety.
