| 摘 要： | 正义是法律制度的首要价值，法的价值在于实现正义，法律是维护正义的最基本的手段。正义是法律进化的精神动力，法律必须根据正义观念的要求不断提升、完善自身的本质。二者相互作用、相辅相成，构成互动作用的关系。
