学术期刊在著作权侵权行为中的法律责任分析

根据民法通则、著作权法等法律、法规的规定,我国著作权侵权损害赔偿的归责原则应该为过错责任原则和一定条件下的过错推定原则.其中过错推定原则在处理著作权侵权赔偿纠纷中起着极为重要的作用.应当注意不要将本应适用过错责任原则,特别是适用过错推定责任原则的情形,错误地适用无过错责任原则,更不能盲目适用无过错责任原则,混淆严肃执法与理论探讨的界限,或者片面理解过错责任原则,轻纵著作权侵权行为.

According to General Provisions of the Civil Law and Copyright Law, the principle of taking responsibility in compensation for copyrights violation is that of fault responsibility and of fault deduction, of which , the latter is of importance. What should be noticed is that not to apply wrongly the principle of no fault responsibility in the situation where the principle of fault responsibility or fault deduction should be adapted, which is of serious consequence.
