论检察官客观义务的现实冲突与调适

检察官客观义务贯穿于刑事诉讼法的始终,侦查、审查起诉、审判各阶段都应体现检察官客观公正的立场。检察官客观义务虽然在大陆法系和英美法系国家发展路径大相径庭,但无一例外都在本国刑诉中规定和反映这一义务的内容和精神。检察官在刑诉活动中的天然偏向、司法一体化的境遇、不合理的内部考核制以及控辩的实质不对等是检察官履行客观义务时所面临的障碍。司法实践中应从内部建设和外部抵制两层面完善检察官的客观义务:需优化诉讼体制、加强职业道德教育、落实检察官责任来加强检察官的内部体制建设;需从辩护权保障和公众多方位监督两方面达成外部抵制。

On Realistic Conflict and Adaptation of Prosecutors Objective Obligation

Prosecutorb objective obligation permeates the criminal litigation, which finds its way throughout the phase of investiga tion, prosecution and trial. Presecutor objective obligation went through different development paths in continental law system and Anglo American law system countries but its content and spirit is exceptionally specified and reflected in their native criminal liti gation. Prosecutor natural bias, integration of justice, irrational internal assessment system and essence of unequal prosecution and defen cur performance of prosecutorb objective obligations. Measures including internal system construction and external preventlons should be taken in the judicial practice to promote prosecntor objective obli,ation, i. e , to build up internal system construc tion by optimizing procedure system, strengthening moral education of occupation, and implementing prosecutor responsibility while to achieve external prevention sbysafeguar. ding the right to defense and encouraging public supervision.
