论宪法框架下的“法治共同体”——就教于高鸿钧教授

清华大学法学院高鸿钧教授在《法学研究》2003年第2期上撰指出,现代法治存在封闭与开放、内信与外迫、确定与无常、普适与特惠、规则与事实等五种困境,摆脱困境的出路在于调整社会结构、社会关系和社会价值,组建自愿共同体,走向“共同体法治”。这一观点是值得商榷的。“依法治国”是一个历史性进程,是一个系统工程,不可能毕其功于一役;法治本身也不是铁板一块,不能兼容。在宪法框架下,深入发掘中、外法治资源,正确认识和把握不同层次法律的价值和功能,弥补现代法治的结构性缺陷,建构民主化、多层次、全方位的法治共同体。才是摆脱“法治困境”的现实途径。

Law-governed Community in the Constitutional Frame--To consult with Professor Gao Hongjun

Professor Gao Hongjun of the law school of Tsing-Hua University, pointed out in his essay published in Study of Law ,the second issue ,2003 ,that modern law involves five predicaments ,i.e., that between openness and closeness, interior trust and exterior pressure, definiteness and irregularity , general application and preferentiality .The outlet of extrication from the predicament lies in adjusting social structure, social relationships and social value, setting up the voluntary community and moving towards " the community rules by law ".This view is worth discussing . " Running the country according to law " is a historical process and a systematic engineering, which is impossible to be accomplished at one stroke . Under the constitutional frame, we need to explore both domestic and foreign law resources, to learn and understand the value and function of law at different levels in order to remedy the structural defect of modern law and construct a democratic, multi-level and omni-directional community governed by law. This is believed to be a realistic way to break away from " the predicament of law ".
