内蒙古嘎查村民委员会候选人资格的法律探讨

《内蒙古自治区实施〈中华人民共和国村民委员会组织法〉办法》是规范我区嘎查村民主自治实践的地方性法规,其中关于嘎查村委员会候选人资格的规定着力于保障广大农、牧民选举与被选举权等政治权利得以实现,这一点是值得肯定的,但是在选举实践中,《办法》中的规定存在约束力不足、规范结构不完整、规范内容不明确等缺陷。因此,应该认真研究完善现行《办法》中关于候选人资格规范的规范形式、规范结构,增加责任条款,通过规范性规则的采用增加候选人资格规范的确定性。

A Legislative Study of Candidacy of Gacha Villager Committee in Inner Mongolia Autonomous Region

"The Means of Implementation for People's Republic of China Villagers Committee Constitutive law in Inner Mongolia Autonomous Region" is a local law regulating the Gacha village's democratic autonomous practice,in which the candidacy of the Gacha village committee focuses on strengenthing the political rights,such as protecting the right of average farmers and herdsmen in election,i.e.the right to elect and to be elected. It is agreeable at this point.However,in the election practice,the articles of"Means" in existence have some defects,i.e.,binding force and regulative structure are insufficient,regulative contents are ambiguious.To consummate the related system of candidacy of Gacha villagers committee in our region,we should earnestly study how to improve the present"Means" about the candidacy by regulating forms and structures,to add the responsibility articals,and to increase the certainty of candidacy rules by adopting regulative rules.
