Intellectual Property of the Old-trade-name, Its Conflict and Resolution

From analyzing the importance of the intellectual property ownership of old-trade-name protection, this thesis expands its views that the nature of the traditional famous names of products which have not registered to trade marks belonging to trade-name right in the intellectual property right system; through summarizing the four right-conflict situations of the old trade-name in reality; then it has analyzed the causes of intellectual property rights-conflict in the old trade-name. Finally, from the legislative, administrative, judicial settlement of the specific recommendations of intellectual property rights conflict in the old trade-name.
