| 摘 要： | 合同法第234条给予了承租人之共同居住人延续合同的权利,共同居住人所享有的是带抗辩性质的形成权。本条中的两个关键名词共同居住人和房屋的外延需作出符合法律的解释。对该条具体适用中的问题,如权利的行使主体、行使方式与结果,章作出了说明。
