| 摘 要： | 在自然人民事责任能力制度的立法模式中,有出生主义、意思主义和识别主义三种不同的立法例,而以识别主义立法例最为科学;在同采识别主义立法例的德国、日本和我国台湾地区的民法典中,尤以德国民法典的立法技术值得借鉴.
