| 摘 要： | 婚育权是高校学生依法应当享有的一项基本权利。文章解析了高校学生婚育权的法律性质,探讨了教育立法与高校校规应当尊重学生婚育权的理论和现实根据,并以学生婚育权保护为视角对高校校规的基本价值定位——秩序进行了重新思考。

| Abstract: | Matrimony and procreation right is a basic right of Higher schools students by the law.The thesis analyses the legal characters of matrimony and procreation right,discusses the theoretic and realistic bases of respecting students'matrimony and procreation right of educa- tional legislation and Higher schools'rules,and then takes a new thinking about the order which is the basic value orientation of Higher schools'rules in the visual angle of protecting students'matrimony and procreation right. |
