| Abstract: | The paper explains the basic attributes of the law discovery from two points: the function analyses and the main body deconstruction;and it discusses the value orientation of the legal discovery with the spirit of the rule and law,that is,pursuing the fairness and the justice,inspiriting the exploring spirit,developing the useful part and discarding the useless part of the traditional role of man and modifying the superiority of the positive law,and establishing an idea of development that the multi-element differences will sustain a society under the role of law. |
