| 摘 要： | 我国法律明确规定煤矿资源属于国家所有,但却未进一步将煤矿资源的所有权和使用权做出区分,导致我国煤矿产权在开采过程中如同虚置。这种情况造成了国有资产流失、地方政府寻租、煤矿安全事故频发、事故责任不明、资源浪费严重、环境污染严重等问题。分析当前我国煤矿资源产权改革的必要性与紧迫性,提出我国煤矿资源产权制度改革的战略对策。

| Abstract: | Chinese law has provided that coal resources belong to the state,but it never makes any distinction between coal resources' ownership and right for use,which causes property right can't function properly in mining process.All these lead to problems such as outflow of national property,local governments' rent seeking,frequent accidents in mines,obscure responsibility in accident and serious resource waste and environmental pollution.This thesis analyses the necessity and pressing of reform in coal resources' property rights,and gives strategic countermeasures to the reform in our system of coal resources' property rights. |
