| 摘 要： | 法院调解几经起伏,在当前构建和谐社会的大背景下正面临着重兴的契机,值得注意的是,现代的法院调解制度不应是简单的历史传承,它必须回应法治建设的需要,协调法律传统与现代社会的平衡,在分析现有机制弊病的基础上,探索原则-模式-制度的创造性转型,从而使这一传统机制在新的历史条件下,重新焕发应有的光彩.
