试论我国刑罚执行机关的行政处罚适用程序

行政处罚是我国很多刑罚执行机关在执法中不可或缺的手段,也是监狱对罪犯实施管理的一种非常重要的手段,但监狱行政处罚的程序并没有相关立法严格规定,影响了其适用的规范性、科学性和统一性,不利于保障罪犯这一特殊群体的合法权益。在依法治国和依法治监的背景下,完善监狱行政处罚的适用程序就显得非常必要。

On the Applicable Executive Penalty Procedures for the Enforcement Authorities

Administrative penalties are indispensable means for our country’s law enforcement,also a very important tool in prison management;however,the prison administrative penalty procedures are without relevant legislative regulations,therefore,lacks standard,science and uniformity.Such deficiencies hamper the protection of the legitimate rights of the special communities of criminals.It is highly necessary to improve the procedures in prison in the context of our country’s rule of law.
