论刑讯逼供产生的原因及对策

刑讯逼供在我国及世界各国都普遍存在,有着深远的历史及现实原因。虽然刑讯逼供已为我国法律所禁止,但实践中这种审讯方式依然存在。如何在立法及司法实践中进一步遏制刑讯逼供的现象．已是当务之急。因此,本文在分析我国刑讯逼供产生原因的基础上,参照国外相关立法,提出确立不被强迫自证其罪的规则、举证责任倒置等一系列规则．并辅以有效的监督机制来遏制刑讯逼供,以达到完善我国刑事诉讼法体制,从而保障犯罪嫌疑人人权的目的。

CAUSES AND STRATEGIES FOR EXTORTION BY TORTURE

Extortion by torture is a worldwide phenomenon which has deep historical and realistic reasons. Though it is forbidden in China, it still exists in practice. Therefore, it is urgent to deter it in both legislative and judicial practice. By analyzing its causes and referring to the relevant legislations in other countries, the article puts forward a series of regulations including proving one＇s own crime without being forced and inverted onus of proof, etc. supplemented with effective supervision mechanisms to stop extortion by torture with the intention of perfecting our criminal procedure system and protecting the human rights of criminal suspects.
