| 摘 要： | 随着我国行政强制法立法列入人大立法议程,对行政强制制度的研究益显重要。由于历史传统和法律制度的差异,大陆法系国家和英美法系国家在行政强制内涵的理解及行政强制的主体、手段、基本程序及法律救济等方面存在很大差异。在我国即将制定的《中华人民共和国行政强制法》中,应当借鉴国外经验,完善我国行政强制制度。

| Abstract: | The legislation of China's Law of Administrative Compulsory is enlisted in the schedule of NPC,so the related study is very important.Because of the difference of historical tradition and law system,there is great difference between continental and Anglo-Saxon countries in terms of the understanding the connotation,the subject,method,basic procedure and law almsgiving,which enlightens in certain way for Chinese corresponding law. |
