我国体育仲裁性质有关问题探讨

从界定体育仲裁的性质入手，分析我国体育仲裁性质。研究认为，公平原则决定了体育仲裁的民间性质和自愿属性，而这种性质定位必然将体育仲裁的范围由竞技体育拓展至整个体育领域。同时，为贯彻体育仲裁的自愿性，对体育实践中广泛存在的强制性体育仲裁条款的效力问题进行分析，提出依法建立相应的效力审查标准的观点，并就建立我国体育仲裁制度提供若干立法建议。

Study on Nature of Sports Arbitration and the Related Problem

Being start with defining the nature of sports arbitration and through the detailed analysis, this paper presents that equitable principle decides on the civil nature and voluntary attribute of sports arbitration, and this nature inevitably amplifies the scope of sports arbitration from competitive sports to the whole sports fields. In the meantime, in order to carry out the voluntary of sports arbitration, this paper further analyzes effect problem of compulsive sports arbitration provision extensively existing in sports practices and presents the viewpoint of building the relevant effect examination standards according to law, put forwards the several legislative suggestions for building our sports arbitration system.
