论数据库的知识产权保护

如何对数据库进行有效的知识产权保护引起了全世界的广泛重视。各国的处理方法各不相同，主要是通过版权、数据库特殊权利等进行保护，这几种方式各有其优点和缺陷。而我国相关立法相对滞后，现行《著作权法》无论是在保护范围还是力度上都不能满足现实的需要，因此，有必要采用多轨制，对不同类型的数据库分剐适用版权、数据库特殊权利及邻接权，以建立起完善的数据库知识产权法律保护制度。

On the Protection of Intellectual Property Rights in Database

This article focuses on some principles of database rights. It first introduces the concept and scope of database rights, then goes on to discuss the advantages and disadvantages of different methods used to protect the intellectual property rights in database such as copyright, sui generis right and competition law. Some problems of this field existing in China are also analysed and finally provided are some legislative suggestions on how to enhance the protection in China, that is, to use copyright, sui generis right and neighboring right in accordance with different kinds of database.
