亲属法的伦理价值取向及其立法对策

亲属法的伦理价值取向是实现个体幸福与家庭和谐,属于富勒所言的“愿望的道德”,是亲属法的法治理想.一方面我们应当将亲属法的伦理价值取向这一“愿望的道德”内化为“义务的道德”,使之成为一种“内在道德”;另一方面我们在设计权利义务条款时应当充分体现亲属法的伦理价值取向,应当弘扬婚姻家庭核心价值之功能,而不要使之成为法官判案的纯粹技术依据.《婚姻法》第4条以及《婚姻法司法解释(三)》有关房产的规定都值得深入检讨.
