论电子商务法的涵义、调整对象

随着电子商务的迅速发展，电子商务立法已经引起人们的广泛关注。但电子商务立法的一个重要前提是正确界定电子商务法的涵义与调整对象。本认为，电子商务法实际上应当被称为电子交易法，它是调整平等主体之间在以电子手段进行交易即电子交易的过程中所形成的权利义务关系的法律规范的统称；与电子商务相对应，电子商务法也有广义、中义和狭义之分。其中，广义的电子商务法调整平等主体在广义电子商务过程中所发生的权利义务关系；狭义的电子商务法则调整平等主体在狭义的电子商务过程中所形成的权利义务关系；中义的电子商务法调整平等的主体在中久的电子商务过程中所形成的权利义务关系；其调整对象既包括交易形式，也包括交易内容。

On the definition and regulation object of e-commerce law

Man has paid attention to the legislation over e-commerce with its development. However, research on the definition and regulation object of e-commerce law almost has been neglected. This article holds that e-commerce law should be called as electronic transaction law, which regulates the relationship of equal subjects in the course of e-transaction, and its regulation includes both the transaction form and the transaction object.
